降薪了是變更了勞動合同嗎?

問(wen) 勞動者到單位(wei)(wei)參加工作,雙(shuang)方會簽(qian)訂勞動合同(tong),就(jiu)存在(zai)勞動關系,那么在(zai)日后(hou)履行合同(tong)的過程中,單位(wei)(wei)對勞動者降薪(xin)的,是變(bian)更了(le)勞動合同(tong)嗎?

《勞(lao)(lao)動(dong)(dong)合同(tong)法》第十七條(tiao)規定(ding)中(zhong),已(yi)將勞(lao)(lao)動(dong)(dong)報酬(chou)列入勞(lao)(lao)動(dong)(dong)合同(tong)必(bi)備條(tiao)款,用(yong)人單位(wei)應當按勞(lao)(lao)動(dong)(dong)合同(tong)約(yue)定(ding)支(zhi)付勞(lao)(lao)動(dong)(dong)者勞(lao)(lao)動(dong)(dong)報酬(chou),如果(guo)用(yong)人單位(wei)需要(yao)調薪(xin),就必(bi)須對(dui)勞(lao)(lao)動(dong)(dong)合同(tong)必(bi)備條(tiao)款進行依(yi)法變更,否則就屬于違法變更,要(yao)支(zhi)付經濟補償(chang)。
