降薪了是變更了勞動合同嗎?

問(wen) 勞(lao)(lao)動(dong)者到單位參加工作,雙方(fang)會(hui)簽訂勞(lao)(lao)動(dong)合(he)同(tong),就存在(zai)勞(lao)(lao)動(dong)關系(xi),那么在(zai)日后履行合(he)同(tong)的過程中(zhong),單位對勞(lao)(lao)動(dong)者降薪(xin)的,是變(bian)更了勞(lao)(lao)動(dong)合(he)同(tong)嗎?

《勞(lao)動(dong)合(he)同(tong)法》第十七條規定中,已將勞(lao)動(dong)報(bao)酬(chou)列入勞(lao)動(dong)合(he)同(tong)必(bi)(bi)備(bei)條款,用人(ren)單位應當按勞(lao)動(dong)合(he)同(tong)約定支(zhi)(zhi)付勞(lao)動(dong)者勞(lao)動(dong)報(bao)酬(chou),如果用人(ren)單位需(xu)要調薪,就必(bi)(bi)須對勞(lao)動(dong)合(he)同(tong)必(bi)(bi)備(bei)條款進行依法變(bian)更,否(fou)則就屬(shu)于違法變(bian)更,要支(zhi)(zhi)付經濟補償。
