勞(lao)(lao)(lao)(lao)動(dong)(dong)者解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),應當提前(qian)三十(shi)日(ri)以(yi)書面形式(shi)通知用(yong)人單(dan)(dan)位。超過三十(shi)日(ri),勞(lao)(lao)(lao)(lao)動(dong)(dong)者可(ke)以(yi)向用(yong)人單(dan)(dan)位提出(chu)辦(ban)理(li)(li)解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)手續(xu),用(yong)人單(dan)(dan)位應予以(yi)辦(ban)理(li)(li)。如果勞(lao)(lao)(lao)(lao)動(dong)(dong)者違(wei)法解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)給原用(yong)人單(dan)(dan)位造成經(jing)濟損失,應當承擔賠償責任(ren)。如勞(lao)(lao)(lao)(lao)動(dong)(dong)者違(wei)反提前(qian)三十(shi)日(ri)的規定而要求解(jie)除(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),用(yong)人單(dan)(dan)位可(ke)不予辦(ban)理(li)(li)。
