答 《勞(lao)動(dong)合(he)(he)同(tong)法》第(di)八十二條規定:用人單(dan)位(wei)(wei)自用工(gong)之日起超(chao)過一個月(yue)不滿一年未(wei)與勞(lao)動(dong)者訂立書面(mian)勞(lao)動(dong)合(he)(he)同(tong)的,應當向(xiang)勞(lao)動(dong)者每月(yue)支付二倍的工(gong)資(zi)(zi)。如果單(dan)位(wei)(wei)不簽訂勞(lao)動(dong)合(he)(he)同(tong),勞(lao)動(dong)者可以提起勞(lao)動(dong)仲(zhong)裁(cai)要(yao)求單(dan)位(wei)(wei)支付雙倍工(gong)資(zi)(zi)。
