勞動合同應在何時簽訂?

問 我在單(dan)位(wei)工作了(le)快一年了(le),單(dan)位(wei)雖然幫(bang)我繳(jiao)納社保,但(dan)是一直(zhi)沒有簽訂勞動合同(tong)。請問(wen)這種情況單(dan)位(wei)違法嗎?
答(da) 根據《勞(lao)動(dong)(dong)合(he)(he)同(tong)法》規定,已(yi)經存在事實勞(lao)動(dong)(dong)關系、用(yong)人(ren)單(dan)位未與勞(lao)動(dong)(dong)者簽訂(ding)或(huo)續訂(ding)勞(lao)動(dong)(dong)合(he)(he)同(tong)的,用(yong)人(ren)單(dan)位自用(yong)工(gong)之日起超過一(yi)個(ge)月不滿一(yi)年(nian)沒有和勞(lao)動(dong)(dong)者簽訂(ding)書面勞(lao)動(dong)(dong)合(he)(he)同(tong),應當向(xiang)勞(lao)動(dong)(dong)者每月支付兩倍的工(gong)資(zi)。
