勞動合同應在何時簽訂?

我在單(dan)位(wei)工作了快一(yi)年了,單(dan)位(wei)雖(sui)然幫我繳納(na)社保,但是一(yi)直沒有簽訂勞動(dong)合(he)同。請問這種(zhong)情況單(dan)位(wei)違法嗎?

答(da) 根據(ju)《勞(lao)動(dong)(dong)(dong)合同法》規定,已經存在事實(shi)勞(lao)動(dong)(dong)(dong)關系、用(yong)(yong)人單位(wei)未與勞(lao)動(dong)(dong)(dong)者(zhe)簽訂或續(xu)訂勞(lao)動(dong)(dong)(dong)合同的,用(yong)(yong)人單位(wei)自(zi)用(yong)(yong)工(gong)之(zhi)日(ri)起超過(guo)一個月不滿一年沒有和勞(lao)動(dong)(dong)(dong)者(zhe)簽訂書面(mian)勞(lao)動(dong)(dong)(dong)合同,應當向勞(lao)動(dong)(dong)(dong)者(zhe)每月支付兩(liang)倍(bei)的工(gong)資。
