答 《勞(lao)(lao)動(dong)(dong)法(fa)》第23條(tiao)(tiao)(tiao)規(gui)定(ding)(ding):“勞(lao)(lao)動(dong)(dong)合同期滿或者當事人(ren)約定(ding)(ding)的(de)(de)(de)(de)勞(lao)(lao)動(dong)(dong)合同終(zhong)(zhong)(zhong)(zhong)止(zhi)條(tiao)(tiao)(tiao)件(jian)出現,勞(lao)(lao)動(dong)(dong)合同即(ji)行終(zhong)(zhong)(zhong)(zhong)止(zhi)。”通(tong)過該規(gui)定(ding)(ding)可(ke)以看出,在(zai)(zai)《勞(lao)(lao)動(dong)(dong)法(fa)》調整下,勞(lao)(lao)動(dong)(dong)合同的(de)(de)(de)(de)終(zhong)(zhong)(zhong)(zhong)止(zhi)條(tiao)(tiao)(tiao)件(jian)分為法(fa)定(ding)(ding)條(tiao)(tiao)(tiao)件(jian)和(he)(he)約定(ding)(ding)條(tiao)(tiao)(tiao)件(jian),即(ji)用人(ren)單位(wei)可(ke)以和(he)(he)勞(lao)(lao)動(dong)(dong)者在(zai)(zai)勞(lao)(lao)動(dong)(dong)合同中約定(ding)(ding)勞(lao)(lao)動(dong)(dong)合同的(de)(de)(de)(de)終(zhong)(zhong)(zhong)(zhong)止(zhi)條(tiao)(tiao)(tiao)件(jian)。只要約定(ding)(ding)的(de)(de)(de)(de)終(zhong)(zhong)(zhong)(zhong)止(zhi)條(tiao)(tiao)(tiao)件(jian)不(bu)違背法(fa)律、法(fa)規(gui)的(de)(de)(de)(de)規(gui)定(ding)(ding),該約定(ding)(ding)就有效,就可(ke)以依據約定(ding)(ding)來終(zhong)(zhong)(zhong)(zhong)止(zhi)雙方的(de)(de)(de)(de)勞(lao)(lao)動(dong)(dong)合同。
