答(da) 勞(lao)動(dong)(dong)者(zhe)與(yu)公司訂有培(pei)(pei)(pei)訓(xun)協(xie)議,約(yue)(yue)定服(fu)務期和違(wei)(wei)約(yue)(yue)金,離職(zhi)時(shi)應賠償公司,但違(wei)(wei)約(yue)(yue)金的數(shu)額(e)最高不得超(chao)過(guo)公司實際提(ti)(ti)(ti)供(gong)(gong)的培(pei)(pei)(pei)訓(xun)費(fei)(fei)用(yong)。《勞(lao)動(dong)(dong)合(he)同(tong)法》第二(er)十二(er)條規定:用(yong)人(ren)單(dan)(dan)位(wei)為(wei)勞(lao)動(dong)(dong)者(zhe)提(ti)(ti)(ti)供(gong)(gong)專項培(pei)(pei)(pei)訓(xun)費(fei)(fei)用(yong),對其(qi)進行專業技術(shu)培(pei)(pei)(pei)訓(xun)的,可(ke)以(yi)與(yu)該勞(lao)動(dong)(dong)者(zhe)訂立(li)協(xie)議,約(yue)(yue)定服(fu)務期。勞(lao)動(dong)(dong)者(zhe)違(wei)(wei)反(fan)服(fu)務期約(yue)(yue)定的,應當按照約(yue)(yue)定向用(yong)人(ren)單(dan)(dan)位(wei)支(zhi)付違(wei)(wei)約(yue)(yue)金。違(wei)(wei)約(yue)(yue)金的數(shu)額(e)不得超(chao)過(guo)用(yong)人(ren)單(dan)(dan)位(wei)提(ti)(ti)(ti)供(gong)(gong)的培(pei)(pei)(pei)訓(xun)費(fei)(fei)用(yong)。用(yong)人(ren)單(dan)(dan)位(wei)要求(qiu)勞(lao)動(dong)(dong)者(zhe)支(zhi)付的違(wei)(wei)約(yue)(yue)金不得超(chao)過(guo)服(fu)務期尚(shang)未履(lv)行部分所應分攤的培(pei)(pei)(pei)訓(xun)費(fei)(fei)用(yong)。
