離職后,公司討要培訓費該給嗎?

勞(lao)(lao)動(dong)(dong)者(zhe)與(yu)公司訂有培訓協議,約(yue)(yue)定(ding)(ding)服(fu)務期(qi)和違(wei)(wei)約(yue)(yue)金(jin)(jin),離職時(shi)應賠償公司,但違(wei)(wei)約(yue)(yue)金(jin)(jin)的數額(e)最(zui)高不得(de)超過公司實際提供的培訓費(fei)用(yong)(yong)(yong)(yong)。《勞(lao)(lao)動(dong)(dong)合同法》第(di)二(er)十二(er)條規(gui)定(ding)(ding):用(yong)(yong)(yong)(yong)人單(dan)位為(wei)勞(lao)(lao)動(dong)(dong)者(zhe)提供專項培訓費(fei)用(yong)(yong)(yong)(yong),對其進行專業技術培訓的,可以與(yu)該勞(lao)(lao)動(dong)(dong)者(zhe)訂立協議,約(yue)(yue)定(ding)(ding)服(fu)務期(qi)。勞(lao)(lao)動(dong)(dong)者(zhe)違(wei)(wei)反服(fu)務期(qi)約(yue)(yue)定(ding)(ding)的,應當按照約(yue)(yue)定(ding)(ding)向(xiang)用(yong)(yong)(yong)(yong)人單(dan)位支(zhi)付(fu)違(wei)(wei)約(yue)(yue)金(jin)(jin)。違(wei)(wei)約(yue)(yue)金(jin)(jin)的數額(e)不得(de)超過用(yong)(yong)(yong)(yong)人單(dan)位提供的培訓費(fei)用(yong)(yong)(yong)(yong)。用(yong)(yong)(yong)(yong)人單(dan)位要求勞(lao)(lao)動(dong)(dong)者(zhe)支(zhi)付(fu)的違(wei)(wei)約(yue)(yue)金(jin)(jin)不得(de)超過服(fu)務期(qi)尚未履行部分所應分攤的培訓費(fei)用(yong)(yong)(yong)(yong)。
