答(da) 首先勞(lao)(lao)(lao)動(dong)者(zhe)患病或(huo)者(zhe)非因工(gong)(gong)負(fu)傷,在規定(ding)的(de)(de)醫療期滿后不(bu)能從(cong)(cong)事原工(gong)(gong)作(zuo),也不(bu)能從(cong)(cong)事由用人單位另(ling)行安(an)排的(de)(de)工(gong)(gong)作(zuo)的(de)(de);其次勞(lao)(lao)(lao)動(dong)者(zhe)不(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo),經過(guo)培訓或(huo)者(zhe)調整(zheng)工(gong)(gong)作(zuo)崗位,仍不(bu)能勝(sheng)任(ren)工(gong)(gong)作(zuo)的(de)(de);最(zui)后勞(lao)(lao)(lao)動(dong)合(he)同訂(ding)立時所(suo)依據的(de)(de)客(ke)觀情況發生重大變化(hua),致使勞(lao)(lao)(lao)動(dong)合(he)同無法履(lv)行,經用人單位與勞(lao)(lao)(lao)動(dong)者(zhe)協商(shang),未能就變更勞(lao)(lao)(lao)動(dong)合(he)同內容達成協議的(de)(de)。
