試用合格后院才簽合同嗎?

答(da) 不(bu)(bu)合(he)(he)法(fa)的(de),根據(ju)《勞動合(he)(he)同(tong)(tong)(tong)法(fa)》第19條規定(ding):“試(shi)(shi)用(yong)期包含在(zai)(zai)勞動合(he)(he)同(tong)(tong)(tong)期限(xian)內。勞動合(he)(he)同(tong)(tong)(tong)僅約(yue)定(ding)試(shi)(shi)用(yong)期的(de),試(shi)(shi)用(yong)期不(bu)(bu)成立,該(gai)期限(xian)為勞動合(he)(he)同(tong)(tong)(tong)期限(xian)。”也就(jiu)(jiu)是說(shuo),試(shi)(shi)用(yong)期是依(yi)附于(yu)勞動合(he)(he)同(tong)(tong)(tong)、以(yi)勞動合(he)(he)同(tong)(tong)(tong)為前提(ti)條件的(de),沒有(you)勞動合(he)(he)同(tong)(tong)(tong)就(jiu)(jiu)沒有(you)試(shi)(shi)用(yong)期條款,不(bu)(bu)存在(zai)(zai)單(dan)獨的(de)“試(shi)(shi)用(yong)期合(he)(he)同(tong)(tong)(tong)”。不(bu)(bu)僅如此,在(zai)(zai)試(shi)(shi)用(yong)期,如果用(yong)人單(dan)位不(bu)(bu)簽書面勞動合(he)(he)同(tong)(tong)(tong)超(chao)過一個(ge)月(yue)的(de),勞動者還可以(yi)依(yi)據(ju)《勞動合(he)(he)同(tong)(tong)(tong)法(fa)》第82條的(de)規定(ding)主張雙倍工資補償。
