單位可以擅自延長試用期嗎?

我們單位會以時間太短、考察不全面、還需繼續(xu)努力為理由,對(dui)原來的(de)試(shi)用期進行延長,這(zhe)樣(yang)做合適嗎(ma)?

答(da) 這種做法是(shi)不對的,《勞動(dong)(dong)(dong)合(he)同法》第19條:“同一用(yong)(yong)(yong)人單(dan)(dan)位與同一勞動(dong)(dong)(dong)者只能(neng)約(yue)定(ding)一次試(shi)(shi)用(yong)(yong)(yong)期。”也(ye)就(jiu)是(shi)說,用(yong)(yong)(yong)人單(dan)(dan)位不得(de)以(yi)任(ren)何理由與勞動(dong)(dong)(dong)者重復約(yue)定(ding)試(shi)(shi)用(yong)(yong)(yong)期,也(ye)不得(de)對原(yuan)來(lai)約(yue)定(ding)的試(shi)(shi)用(yong)(yong)(yong)期進行延長(chang)。如(ru)果單(dan)(dan)位在一次試(shi)(shi)用(yong)(yong)(yong)的合(he)理時間(jian)內依然不能(neng)判斷勞動(dong)(dong)(dong)者是(shi)否能(neng)勝(sheng)任(ren)工作,就(jiu)應該承擔由此而帶來(lai)的風險。
