用(yong)(yong)(yong)(yong)人(ren)單(dan)位經職(zhi)(zhi)(zhi)工(gong)同(tong)意不(bu)安排(pai)(pai)年休(xiu)(xiu)(xiu)假(jia)(jia)或(huo)(huo)者(zhe)安排(pai)(pai)職(zhi)(zhi)(zhi)工(gong)年休(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)(tian)數(shu)(shu)少于應(ying)(ying)休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)(tian)數(shu)(shu),應(ying)(ying)當(dang)在本年度內對職(zhi)(zhi)(zhi)工(gong)應(ying)(ying)休(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)(tian)數(shu)(shu),按(an)照(zhao)其(qi)(qi)(qi)日工(gong)資收入的(de)(de)300%支(zhi)付(fu)未休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)工(gong)資報酬,其(qi)(qi)(qi)中(zhong)包含(han)用(yong)(yong)(yong)(yong)人(ren)單(dan)位支(zhi)付(fu)職(zhi)(zhi)(zhi)工(gong)正常工(gong)作期間(jian)的(de)(de)工(gong)資收入。用(yong)(yong)(yong)(yong)人(ren)單(dan)位安排(pai)(pai)職(zhi)(zhi)(zhi)工(gong)休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia),但(dan)是職(zhi)(zhi)(zhi)工(gong)因本人(ren)原因且書面提出(chu)不(bu)休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)的(de)(de),用(yong)(yong)(yong)(yong)人(ren)單(dan)位可以(yi)只支(zhi)付(fu)其(qi)(qi)(qi)正常工(gong)作期間(jian)的(de)(de)工(gong)資收入。勞動合同(tong)、集體合同(tong)約定的(de)(de)或(huo)(huo)者(zhe)用(yong)(yong)(yong)(yong)人(ren)單(dan)位規章制度規定的(de)(de)年休(xiu)(xiu)(xiu)假(jia)(jia)天(tian)(tian)(tian)數(shu)(shu)、未休(xiu)(xiu)(xiu)年休(xiu)(xiu)(xiu)假(jia)(jia)工(gong)資報酬高于法定標準(zhun)的(de)(de),用(yong)(yong)(yong)(yong)人(ren)單(dan)位應(ying)(ying)當(dang)按(an)照(zhao)有關約定或(huo)(huo)者(zhe)規定執行。
