降薪是變更了勞動合同嗎?

問 勞動(dong)者到單(dan)位參加工作(zuo),雙方會(hui)簽訂勞動(dong)合(he)同(tong),勞動(dong)關系存,那(nei)么在日(ri)后履行合(he)同(tong)的過(guo)程中,單(dan)位對勞動(dong)者降薪的,是變更了勞動(dong)合(he)同(tong)嗎?
答 《勞(lao)(lao)動(dong)(dong)合(he)同法》第十七條(tiao)(tiao)規定中,已將勞(lao)(lao)動(dong)(dong)報(bao)酬(chou)列入勞(lao)(lao)動(dong)(dong)合(he)同必備條(tiao)(tiao)款(kuan),用人單位應(ying)當按勞(lao)(lao)動(dong)(dong)合(he)同約定支(zhi)付勞(lao)(lao)動(dong)(dong)者勞(lao)(lao)動(dong)(dong)報(bao)酬(chou),如果用人單位需要調薪(xin),就必須對勞(lao)(lao)動(dong)(dong)合(he)同必備條(tiao)(tiao)款(kuan)進行(xing)依法變更(geng),否則就屬于違法變更(geng),要支(zhi)付經濟補償。
