勞動者不想簽勞動合同怎么辦?

問(wen) 我是(shi)一(yi)家單位的(de)領導,最近來(lai)的(de)五個新員工,商量好的(de)似的(de),都不(bu)簽(qian)勞動合同,怎么辦呢?

如果勞(lao)動(dong)(dong)者(zhe)(zhe)拒絕簽(qian)訂勞(lao)動(dong)(dong)合同,單位(wei)應當以書(shu)面(mian)(mian)(mian)形式通(tong)知限(xian)期簽(qian)定,仍不簽(qian)定的,書(shu)面(mian)(mian)(mian)通(tong)知終止合同。自用工之(zhi)日起一個(ge)月內,經(jing)用人單位(wei)書(shu)面(mian)(mian)(mian)通(tong)知后,勞(lao)動(dong)(dong)者(zhe)(zhe)不與用人單位(wei)訂立書(shu)面(mian)(mian)(mian)勞(lao)動(dong)(dong)合同的,用人單位(wei)應當書(shu)面(mian)(mian)(mian)通(tong)知勞(lao)動(dong)(dong)者(zhe)(zhe)終止勞(lao)動(dong)(dong)關系(xi),無需向(xiang)勞(lao)動(dong)(dong)者(zhe)(zhe)支付(fu)經(jing)濟補償,但是應當依(yi)法向(xiang)勞(lao)動(dong)(dong)者(zhe)(zhe)支付(fu)其實際工作時間(jian)的勞(lao)動(dong)(dong)報酬。
