答(da) 《勞(lao)(lao)動(dong)(dong)(dong)合同(tong)法(fa)》第(di)十六(liu)條規定(ding):“勞(lao)(lao)動(dong)(dong)(dong)合同(tong)是勞(lao)(lao)動(dong)(dong)(dong)者與用人單位確(que)立勞(lao)(lao)動(dong)(dong)(dong)關(guan)系、明確(que)雙方權利和義(yi)務(wu)的(de)協議(yi)。建立勞(lao)(lao)動(dong)(dong)(dong)關(guan)系應當訂立勞(lao)(lao)動(dong)(dong)(dong)合同(tong)。”因此公司不(bu)與員工(gong)簽(qian)訂勞(lao)(lao)動(dong)(dong)(dong)合同(tong)是違法(fa)的(de),員工(gong)可以到(dao)單位所在地的(de)勞(lao)(lao)動(dong)(dong)(dong)監(jian)察部門投訴解決,如果工(gong)作時間不(bu)超過一年,可以主張雙倍(bei)工(gong)資差額部分的(de)返還(huan)。
