答 《勞(lao)動(dong)合同(tong)(tong)(tong)法(fa)(fa)》第十六條規定:“勞(lao)動(dong)合同(tong)(tong)(tong)是勞(lao)動(dong)者與(yu)用人單位確立(li)勞(lao)動(dong)關系(xi)、明確雙方權(quan)利(li)和(he)義務的協議。建立(li)勞(lao)動(dong)關系(xi)應當(dang)訂立(li)勞(lao)動(dong)合同(tong)(tong)(tong)。”因此公(gong)司不與(yu)員(yuan)工(gong)(gong)簽訂勞(lao)動(dong)合同(tong)(tong)(tong)是違法(fa)(fa)的,員(yuan)工(gong)(gong)可以到單位所(suo)在地的勞(lao)動(dong)監(jian)察部(bu)(bu)門投(tou)訴解決,如果(guo)工(gong)(gong)作(zuo)時(shi)間不超過一年,可以主(zhu)張雙倍工(gong)(gong)資差額部(bu)(bu)分的返還。
