“終止”與“解除”勞動合同是一回事嗎?

我(wo)是一名濟(ji)南的職場新人,想大體了解一下,“終止”與(yu)“解除”勞動合同是一回(hui)事(shi)嗎(ma)?

當然(ran)不是(shi)一回事了(le),根據勞(lao)動部有關規(gui)(gui)定(ding)(ding),勞(lao)動合(he)(he)同(tong)(tong)(tong)的(de)(de)解除是(shi)指勞(lao)動合(he)(he)同(tong)(tong)(tong)訂立后,尚未全部履行以(yi)前,由于某種(zhong)原因(yin)導致(zhi)勞(lao)動合(he)(he)同(tong)(tong)(tong)一方(fang)或雙(shuang)方(fang)當事人提前消滅勞(lao)動關系的(de)(de)法(fa)律行為(wei)。勞(lao)動合(he)(he)同(tong)(tong)(tong)的(de)(de)解除分為(wei)法(fa)定(ding)(ding)解除和約(yue)(yue)定(ding)(ding)解除兩種(zhong)。而勞(lao)動合(he)(he)同(tong)(tong)(tong)的(de)(de)終止,是(shi)指勞(lao)動合(he)(he)同(tong)(tong)(tong)期限(xian)屆(jie)滿或者有其他符合(he)(he)法(fa)律規(gui)(gui)定(ding)(ding)的(de)(de)情形(xing)(xing)出現導致(zhi)勞(lao)動合(he)(he)同(tong)(tong)(tong)關系消滅。按照《勞(lao)動合(he)(he)同(tong)(tong)(tong)法(fa)》規(gui)(gui)定(ding)(ding),勞(lao)動合(he)(he)同(tong)(tong)(tong)的(de)(de)終止只有法(fa)定(ding)(ding)情形(xing)(xing)的(de)(de)終止,而不能有約(yue)(yue)定(ding)(ding)條(tiao)件下的(de)(de)終止,否(fou)則,即使約(yue)(yue)定(ding)(ding)了(le),也是(shi)無效(xiao)的(de)(de)。
