當然不(bu)是一回(hui)事了,根(gen)據(ju)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)部有(you)關(guan)規定(ding)(ding)(ding),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)解(jie)除是指勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)訂立后,尚未(wei)全(quan)部履行以(yi)前(qian),由于某種原因導致(zhi)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)一方或雙方當事人提(ti)前(qian)消滅勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi)的(de)法律行為(wei)。勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)解(jie)除分為(wei)法定(ding)(ding)(ding)解(jie)除和(he)約定(ding)(ding)(ding)解(jie)除兩種。而(er)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)終止(zhi),是指勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)期限屆滿或者有(you)其他符合(he)(he)法律規定(ding)(ding)(ding)的(de)情(qing)形出(chu)現導致(zhi)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)關(guan)系(xi)消滅。按照《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)法》規定(ding)(ding)(ding),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)終止(zhi)只有(you)法定(ding)(ding)(ding)情(qing)形的(de)終止(zhi),而(er)不(bu)能有(you)約定(ding)(ding)(ding)條件下(xia)的(de)終止(zhi),否(fou)則,即使約定(ding)(ding)(ding)了,也是無效的(de)。
