答 辭職(zhi)是勞(lao)動(dong)(dong)者(zhe)(zhe)向(xiang)用(yong)人(ren)單位提出解除(chu)勞(lao)動(dong)(dong)合(he)(he)同(tong)或勞(lao)動(dong)(dong)關系的(de)行為。《勞(lao)動(dong)(dong)法》第(di)31條《勞(lao)動(dong)(dong)合(he)(he)同(tong)法》第(di)37條規定(ding)了(le)勞(lao)動(dong)(dong)者(zhe)(zhe)可以(yi)提前30天(tian)通(tong)(tong)知用(yong)人(ren)單位解除(chu)勞(lao)動(dong)(dong)合(he)(he)同(tong)。如果沒有雙方約定(ding)的(de)超(chao)過30天(tian)的(de)提前通(tong)(tong)知期的(de)規定(ding),則在勞(lao)動(dong)(dong)者(zhe)(zhe)通(tong)(tong)知30天(tian)后,勞(lao)動(dong)(dong)者(zhe)(zhe)和用(yong)人(ren)單位的(de)勞(lao)動(dong)(dong)關系或勞(lao)動(dong)(dong)合(he)(he)同(tong)解除(chu)。
