單位辭退什么樣的職工需要支付經濟補償?
問 我有一個朋(peng)友(you)前幾天(tian)被(bei)單位(wei)辭退了,他本人并沒(mei)有什么(me)違(wei)規違(wei)紀行為,這樣(yang)的情況他的單位(wei)應該付給(gei)經(jing)濟補償嗎?
答 《勞動(dong)(dong)合(he)同(tong)(tong)(tong)法》第40條規定(ding):在以(yi)下三種(zhong)情形下,用人(ren)(ren)單位(wei)向勞動(dong)(dong)者提出解除勞動(dong)(dong)合(he)同(tong)(tong)(tong)時(shi),應支付經(jing)(jing)濟補償金(jin): (1)勞動(dong)(dong)者患病或(huo)(huo)者非因工負傷,在規定(ding)的(de)醫療期滿(man)后不能(neng)(neng)從事(shi)原工作(zuo),也不能(neng)(neng)從事(shi)由用人(ren)(ren)單位(wei)另(ling)行(xing)安排(pai)的(de)工作(zuo)的(de); (2)勞動(dong)(dong)者不能(neng)(neng)勝任工作(zuo),經(jing)(jing)過培訓或(huo)(huo)者調整工作(zuo)崗位(wei),仍不能(neng)(neng)勝任工作(zuo)的(de); (3)勞動(dong)(dong)合(he)同(tong)(tong)(tong)訂立時(shi)所依據的(de)客觀(guan)情況發生重大變化,致使(shi)勞動(dong)(dong)合(he)同(tong)(tong)(tong)無法履行(xing),經(jing)(jing)用人(ren)(ren)單位(wei)與勞動(dong)(dong)者協(xie)商(shang),未能(neng)(neng)就變更勞動(dong)(dong)合(he)同(tong)(tong)(tong)內容達成(cheng)協(xie)議的(de)。
