單位辭退什么樣的職工需要支付經濟補償?

我有(you)一個朋友前幾天被單(dan)位辭退了(le),他(ta)本(ben)人并沒有(you)什么違(wei)規(gui)違(wei)紀行為,這樣的情況(kuang)他(ta)的單(dan)位應該付給經(jing)濟(ji)補償嗎?

《勞(lao)動(dong)(dong)合(he)同法》第40條(tiao)規(gui)定(ding):在以下三種(zhong)情形下,用人(ren)單位向勞(lao)動(dong)(dong)者(zhe)提(ti)出解除勞(lao)動(dong)(dong)合(he)同時,應支(zhi)付經濟(ji)補(bu)償金: (1)勞(lao)動(dong)(dong)者(zhe)患(huan)病或者(zhe)非因工(gong)(gong)負傷,在規(gui)定(ding)的(de)醫療期滿后不能從事(shi)原(yuan)工(gong)(gong)作(zuo),也不能從事(shi)由用人(ren)單位另行安排的(de)工(gong)(gong)作(zuo)的(de); (2)勞(lao)動(dong)(dong)者(zhe)不能勝任工(gong)(gong)作(zuo),經過(guo)培訓(xun)或者(zhe)調整工(gong)(gong)作(zuo)崗位,仍(reng)不能勝任工(gong)(gong)作(zuo)的(de); (3)勞(lao)動(dong)(dong)合(he)同訂立時所依據的(de)客觀情況發生(sheng)重(zhong)大(da)變化(hua),致使勞(lao)動(dong)(dong)合(he)同無法履行,經用人(ren)單位與勞(lao)動(dong)(dong)者(zhe)協(xie)商,未能就變更(geng)勞(lao)動(dong)(dong)合(he)同內容(rong)達成(cheng)協(xie)議的(de)。
