答(da) 根據《勞(lao)工(gong)合(he)(he)同(tong)法(fa)》第(di)十(shi)六(liu)條(tiao)(tiao)(tiao) 勞(lao)動(dong)(dong)合(he)(he)同(tong)由用(yong)(yong)(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)協(xie)商一(yi)致，并經用(yong)(yong)(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)在勞(lao)動(dong)(dong)合(he)(he)同(tong)文本上簽字或(huo)者(zhe)(zhe)蓋章(zhang)生效。勞(lao)動(dong)(dong)合(he)(he)同(tong)文本由用(yong)(yong)(yong)人(ren)單(dan)位(wei)和(he)勞(lao)動(dong)(dong)者(zhe)(zhe)各執一(yi)份(fen)。第(di)十(shi)七條(tiao)(tiao)(tiao) 勞(lao)動(dong)(dong)合(he)(he)同(tong)應(ying)當具備以下條(tiao)(tiao)(tiao)款： （一(yi)）用(yong)(yong)(yong)人(ren)單(dan)位(wei)的名稱、住(zhu)所和(he)法(fa)定(ding)代表(biao)人(ren)或(huo)者(zhe)(zhe)主要負責人(ren)； （二）勞(lao)動(dong)(dong)者(zhe)(zhe)的姓名、住(zhu)址和(he)居民身份(fen)證(zheng)或(huo)者(zhe)(zhe)其(qi)他有效身份(fen)證(zheng)件號碼； （三）勞(lao)動(dong)(dong)合(he)(he)同(tong)期(qi)限(xian)； （四）工(gong)作(zuo)內容和(he)工(gong)作(zuo)地點； （五）工(gong)作(zuo)時間和(he)休息休假； （六(liu)）勞(lao)動(dong)(dong)報酬； （七）社會保險； （八）勞(lao)動(dong)(dong)保護(hu)、勞(lao)動(dong)(dong)條(tiao)(tiao)(tiao)件和(he)職業危(wei)害防護(hu)； （九）法(fa)律、法(fa)規規定(ding)應(ying)當納入勞(lao)動(dong)(dong)合(he)(he)同(tong)的其(qi)他事(shi)項。 勞(lao)動(dong)(dong)合(he)(he)同(tong)除(chu)前(qian)款規定(ding)的必備條(tiao)(tiao)(tiao)款外，用(yong)(yong)(yong)人(ren)單(dan)位(wei)與(yu)勞(lao)動(dong)(dong)者(zhe)(zhe)可以約定(ding)試(shi)用(yong)(yong)(yong)期(qi)、培(pei)訓、保守(shou)秘密、補(bu)充保險和(he)福利待遇(yu)等(deng)其(qi)他事(shi)項。
