加班工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)計(ji)算(suan)方法的法律依據是《中華人民共和國勞動(dong)法》 第四十(shi)四條規定: 有(you)下(xia)列情形之(zhi)一(yi)(yi)的,用(yong)人單(dan)位(wei)應當按(an)照下(xia)列標(biao)準支付(fu)高于(yu)勞動(dong)者正(zheng)常工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)時間(jian)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou):   (一(yi)(yi))安(an)排勞動(dong)者延(yan)長時間(jian)的,支付(fu)不(bu)低(di)于(yu)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的百(bai)分(fen)之(zhi)一(yi)(yi)百(bai)五十(shi)的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou);   (二(er))休(xiu)息日安(an)排勞動(dong)者工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)又不(bu)能安(an)排補(bu)休(xiu)的,支付(fu)不(bu)低(di)于(yu)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的百(bai)分(fen)之(zhi)二(er)百(bai)的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou);   (三(san))法定休(xiu)假日安(an)排勞動(dong)者工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)的,支付(fu)不(bu)低(di)于(yu)工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的百(bai)分(fen)之(zhi)三(san)百(bai)的工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)報(bao)酬(chou)。 用(yong)人單(dan)位(wei)與勞動(dong)者無任(ren)何約定,假期工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的計(ji)算(suan)基數(shu)統一(yi)(yi)按(an)勞動(dong)者本人所在崗位(wei)正(zheng)常出勤(qin)的月工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)的70%確定。日工(gong)(gong)(gong)(gong)(gong)資(zi)(zi)計(ji)算(suan)是以基數(shu)除(chu)以每月平均制(zhi)度工(gong)(gong)(gong)(gong)(gong)作(zuo)(zuo)天數(shu)20.92天。
