實行計件工資還需要支付加班費嗎?

我所工作的公司(si)實行的工資制度是計件工資,但是工作時間以外的加班卻不給(gei)加班費,公司(si)這(zhe)么(me)做合法嗎?

《工(gong)(gong)資支付(fu)暫行(xing)規定(ding)(ding)(ding)》規定(ding)(ding)(ding),單(dan)(dan)位(wei)在(zai)勞動者完(wan)成勞動定(ding)(ding)(ding)額(e)或規定(ding)(ding)(ding)的(de)(de)工(gong)(gong)作任(ren)務后,安排(pai)勞動者在(zai)法(fa)定(ding)(ding)(ding)標準(zhun)工(gong)(gong)作時(shi)間(jian)以(yi)外(wai)工(gong)(gong)作的(de)(de),應(ying)按(an)150%、200%及最高300%的(de)(de)標準(zhun)支付(fu)工(gong)(gong)資。實行(xing)計件工(gong)(gong)資的(de)(de)勞動者,在(zai)完(wan)成計件定(ding)(ding)(ding)額(e)任(ren)務后,由用人單(dan)(dan)位(wei)安排(pai)延長工(gong)(gong)作時(shi)間(jian)的(de)(de),也應(ying)根據上述規定(ding)(ding)(ding)的(de)(de)原(yuan)則,分(fen)別(bie)按(an)照不(bu)低(di)于其本人法(fa)定(ding)(ding)(ding)工(gong)(gong)作時(shi)間(jian)計件單(dan)(dan)價的(de)(de)上述倍數支付(fu)其工(gong)(gong)資。
