實行計件工資還需要支付加班費嗎?

我所工(gong)(gong)作(zuo)的公司實行(xing)的工(gong)(gong)資制度是計(ji)件(jian)工(gong)(gong)資,但是工(gong)(gong)作(zuo)時間以(yi)外的加(jia)班卻不給加(jia)班費,公司這么(me)做合法嗎?

《工(gong)(gong)(gong)資(zi)(zi)支付(fu)暫行規(gui)定(ding)》規(gui)定(ding),單(dan)位在勞(lao)動者完成(cheng)勞(lao)動定(ding)額或規(gui)定(ding)的(de)(de)工(gong)(gong)(gong)作任(ren)務(wu)后,安(an)排勞(lao)動者在法(fa)定(ding)標準工(gong)(gong)(gong)作時(shi)間以(yi)外(wai)工(gong)(gong)(gong)作的(de)(de),應按150%、200%及最高300%的(de)(de)標準支付(fu)工(gong)(gong)(gong)資(zi)(zi)。實行計件(jian)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)勞(lao)動者,在完成(cheng)計件(jian)定(ding)額任(ren)務(wu)后,由用人單(dan)位安(an)排延長(chang)工(gong)(gong)(gong)作時(shi)間的(de)(de),也應根據上述規(gui)定(ding)的(de)(de)原則,分別按照(zhao)不(bu)低于其本人法(fa)定(ding)工(gong)(gong)(gong)作時(shi)間計件(jian)單(dan)價的(de)(de)上述倍數支付(fu)其工(gong)(gong)(gong)資(zi)(zi)。
