實行計件工資還需要支付加班費嗎?

我(wo)所工(gong)作的公(gong)司實行(xing)的工(gong)資制度是計件工(gong)資,但(dan)是工(gong)作時(shi)間以(yi)外的加班卻不(bu)給加班費(fei),公(gong)司這么做合法嗎?

《工(gong)(gong)資(zi)(zi)支付暫行規(gui)(gui)定(ding)》規(gui)(gui)定(ding),單位在勞動(dong)(dong)者完成(cheng)勞動(dong)(dong)定(ding)額或規(gui)(gui)定(ding)的(de)(de)工(gong)(gong)作(zuo)任務后,安排勞動(dong)(dong)者在法(fa)定(ding)標準工(gong)(gong)作(zuo)時間(jian)以外工(gong)(gong)作(zuo)的(de)(de),應(ying)按150%、200%及(ji)最高300%的(de)(de)標準支付工(gong)(gong)資(zi)(zi)。實行計件工(gong)(gong)資(zi)(zi)的(de)(de)勞動(dong)(dong)者,在完成(cheng)計件定(ding)額任務后,由用人單位安排延長(chang)工(gong)(gong)作(zuo)時間(jian)的(de)(de),也應(ying)根據上(shang)述規(gui)(gui)定(ding)的(de)(de)原(yuan)則,分別按照不低于(yu)其本人法(fa)定(ding)工(gong)(gong)作(zuo)時間(jian)計件單價(jia)的(de)(de)上(shang)述倍數支付其工(gong)(gong)資(zi)(zi)。
