未簽訂勞動合同還需要提前一個月申請辭職嗎?

我(wo)來(lai)公(gong)司工作(zuo)四個多月了,公(gong)司依然沒(mei)有與我(wo)簽(qian)訂勞動合同,也沒(mei)有繳(jiao)納保(bao)險,我(wo)想(xiang)要辭職,還需要提前一個月申請碼?

《勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)法(fa)》第10條規(gui)定(ding):建(jian)立(li)勞動(dong)(dong)(dong)關(guan)系,應當(dang)(dang)訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)。已建(jian)立(li)勞動(dong)(dong)(dong) 關(guan)系,未(wei)同(tong)(tong)(tong)時訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de),應當(dang)(dang)自用工之日(ri)起一(yi)個月內訂立(li)書(shu)面勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong) 。第30條規(gui)定(ding):用人單(dan)位(wei)應當(dang)(dang)按照(zhao)勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong)約定(ding)和(he)國家(jia)規(gui)定(ding),向(xiang)勞動(dong)(dong)(dong)者及時足額支(zhi) 付勞動(dong)(dong)(dong)報酬。這就說明公司不(bu)與你(ni)簽訂勞動(dong)(dong)(dong)合(he)(he)同(tong)(tong)(tong),也不(bu)繳納保險(xian)都是(shi)違法(fa)的(de),你(ni)是(shi)有(you)權(quan)隨時辭職的(de),無需提前一(yi)個月申請。
