未簽訂勞動合同還需要提前一個月申請辭職嗎?

我來(lai)公司(si)工(gong)作四個多月(yue)了(le),公司(si)依然沒有與(yu)我簽(qian)訂勞(lao)動合同(tong),也(ye)沒有繳納保險,我想要辭(ci)職,還需要提前一(yi)個月(yue)申請碼?

《勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)法》第(di)10條(tiao)(tiao)規定(ding):建立勞(lao)(lao)動(dong)(dong)(dong)關(guan)系(xi),應當訂(ding)立書面勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)。已建立勞(lao)(lao)動(dong)(dong)(dong) 關(guan)系(xi),未同(tong)(tong)時(shi)(shi)訂(ding)立書面勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)的,應當自用(yong)工之日起一個月內(nei)訂(ding)立書面勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong) 。第(di)30條(tiao)(tiao)規定(ding):用(yong)人單(dan)位(wei)應當按(an)照勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong)約定(ding)和國家規定(ding),向勞(lao)(lao)動(dong)(dong)(dong)者及時(shi)(shi)足額(e)支 付勞(lao)(lao)動(dong)(dong)(dong)報(bao)酬。這(zhe)就說明公司不與你(ni)簽訂(ding)勞(lao)(lao)動(dong)(dong)(dong)合(he)同(tong)(tong),也不繳(jiao)納保險都是(shi)違法的,你(ni)是(shi)有權(quan)隨(sui)時(shi)(shi)辭職的,無需(xu)提前一個月申請(qing)。
