企業不提供合同規定的勞動條件和報酬怎么辦?

答(da) 根據《勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)法(fa)》第(di)38條第(di)1款第(di)1項的(de)(de)規(gui)定,用人單位未能按照勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)約(yue)定提(ti)供勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條件(jian)的(de)(de),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者可以解除勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)。勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)對于員(yuan)工來講既(ji)是(shi)義務也(ye)是(shi)權(quan)利,如果用人單位擅(shan)自變(bian)更勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)的(de)(de)內容,就屬(shu)于違反勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)合(he)(he)同(tong)(tong)約(yue)定的(de)(de)內容,不提(ti)供約(yue)定的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)條件(jian),勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)者有權(quan)利解除與單位的(de)(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)(dong)(dong)關系(xi)。
