企業不提供合同規定的勞動條件和報酬怎么辦?

答 根據《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)法》第(di)38條第(di)1款第(di)1項的規定,用人(ren)單位(wei)未能按(an)照勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定提供勞(lao)(lao)(lao)動(dong)(dong)條件的,勞(lao)(lao)(lao)動(dong)(dong)者可以解除勞(lao)(lao)(lao)動(dong)(dong)關系。勞(lao)(lao)(lao)動(dong)(dong)對于員工來(lai)講既是義務也(ye)是權利,如果(guo)用人(ren)單位(wei)擅自(zi)變更勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)的內容(rong),就屬于違(wei)反(fan)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)約定的內容(rong),不提供約定的勞(lao)(lao)(lao)動(dong)(dong)條件,勞(lao)(lao)(lao)動(dong)(dong)者有權利解除與單位(wei)的勞(lao)(lao)(lao)動(dong)(dong)關系。
