年假沒休夠,單位是否該支付相應的工資?

去年的年假我只休(xiu)了兩天,要(yao)求單位支(zhi)付未(wei)休(xiu)年休(xiu)假的工資報酬,可是卻被拒(ju)絕了,單位這么做(zuo)合理嗎?

《企(qi)業職(zhi)(zhi)工(gong)(gong)(gong)帶薪年休(xiu)假實施(shi)辦法(fa)》第十(shi)條規定:“用(yong)人(ren)單(dan)位經職(zhi)(zhi)工(gong)(gong)(gong)同意不(bu)安排年休(xiu)假或者安排職(zhi)(zhi)工(gong)(gong)(gong)年休(xiu)假天數(shu)(shu)少(shao)于應休(xiu)年休(xiu)假天數(shu)(shu),應當在(zai)本年度內對職(zhi)(zhi)工(gong)(gong)(gong)應休(xiu)未(wei)休(xiu)年休(xiu)假天數(shu)(shu),按照其(qi)日工(gong)(gong)(gong)資收入的300%支付未(wei)休(xiu)年休(xiu)假工(gong)(gong)(gong)資報酬,其(qi)中包(bao)含用(yong)人(ren)單(dan)位支付職(zhi)(zhi)工(gong)(gong)(gong)正常工(gong)(gong)(gong)作期間的工(gong)(gong)(gong)資收入。所(suo)以,你所(suo)在(zai)單(dan)位的做(zuo)法(fa)是不(bu)合理的。
