青島檢查用工社保情況 帶薪年假高溫費成重點

為進一步貫(guan)徹落實《勞(lao)(lao)動(dong)法(fa)(fa)》、《勞(lao)(lao)動(dong)合同法(fa)(fa)》、《社(she)(she)會保(bao)險法(fa)(fa)》等勞(lao)(lao)動(dong)保(bao)障法(fa)(fa)律(lv)(lv)法(fa)(fa)規(gui),構建和諧(xie)勞(lao)(lao)動(dong)關系(xi),維護勞(lao)(lao)動(dong)者的合法(fa)(fa)權(quan)益和社(she)(she)會穩定,根據國家、省相關部門(men)的部署,近期,青(qing)島市人力資源社(she)(she)會保(bao)障部門(men)在全(quan)市組織開展用人單(dan)位遵守勞(lao)(lao)動(dong)用工和社(she)(she)會保(bao)險法(fa)(fa)律(lv)(lv)法(fa)(fa)規(gui)情(qing)況專項(xiang)檢查。

主要檢(jian)查(cha)(cha)用(yong)(yong)人單位與(yu)勞動者簽訂勞動合同(tong)情況(kuang);按照法(fa)律規(gui)定(ding)支付職工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)、執行最低工(gong)(gong)(gong)資(zi)(zi)標準(zhun)及(ji)(ji)加班工(gong)(gong)(gong)資(zi)(zi)規(gui)定(ding)情況(kuang);依法(fa)參加社(she)會保(bao)險和繳(jiao)納社(she)會保(bao)險費(fei)情況(kuang);遵守禁止使(shi)用(yong)(yong)童(tong)工(gong)(gong)(gong)規(gui)定(ding)及(ji)(ji)女職工(gong)(gong)(gong)和未成年工(gong)(gong)(gong)特殊勞動保(bao)護規(gui)定(ding)情況(kuang);遵守工(gong)(gong)(gong)時規(gui)定(ding)及(ji)(ji)帶薪年休假規(gui)定(ding)情況(kuang);遵守高溫天(tian)氣勞動保(bao)護規(gui)定(ding)情況(kuang);企業使(shi)用(yong)(yong)勞務派(pai)遣用(yong)(yong)工(gong)(gong)(gong)情況(kuang);其他遵守勞動保(bao)障(zhang)法(fa)律法(fa)規(gui)的情況(kuang)等(deng)。本(ben)次檢(jian)查(cha)(cha)活動,一是(shi)突出治理農(nong)民(min)工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(zi)拖欠問題,將招用(yong)(yong)農(nong)民(min)工(gong)(gong)(gong)較多的建筑市政(zheng)、交通、水利等(deng)工(gong)(gong)(gong)程建設領域企業作(zuo)為檢(jian)查(cha)(cha)重點;二是(shi)著力做好(hao)產(chan)能(neng)過剩(sheng)企業工(gong)(gong)(gong)資(zi)(zi)支付保(bao)障(zhang),對鋼鐵、煤炭(tan)等(deng)產(chan)能(neng)過剩(sheng)企業實施重點檢(jian)查(cha)(cha)。

另外,省(sheng)(sheng)人社廳依(yi)據《山東省(sheng)(sheng)勞動和社會保障監察(cha)條(tiao)例》的有關規定,授權青(qing)島市在此次(ci)專(zhuan)項檢(jian)查(cha)(cha)期(qi)間可以對省(sheng)(sheng)勞動保障監察(cha)管轄的用(yong)人單位實施檢(jian)查(cha)(cha),這也是我(wo)市首(shou)次(ci)對省(sheng)(sheng)管企業(ye)進行主動檢(jian)查(cha)(cha)。

針對近(jin)期我(wo)市高(gao)溫(wen)(wen)濕(shi)熱天氣,此次(ci)專項檢查中將把防(fang)暑降(jiang)(jiang)溫(wen)(wen)費發(fa)放作(zuo)(zuo)為重點檢查內容。今(jin)年企業(ye)(ye)(ye)職工防(fang)暑降(jiang)(jiang)溫(wen)(wen)費發(fa)放標準為:從事室外作(zuo)(zuo)業(ye)(ye)(ye)和高(gao)溫(wen)(wen)作(zuo)(zuo)業(ye)(ye)(ye)人(ren)(ren)員每(mei)人(ren)(ren)每(mei)月(yue)(yue)(yue)(yue)200元(yuan);非高(gao)溫(wen)(wen)作(zuo)(zuo)業(ye)(ye)(ye)人(ren)(ren)員每(mei)人(ren)(ren)每(mei)月(yue)(yue)(yue)(yue)140元(yuan)。全年按(an)6月(yue)(yue)(yue)(yue)、7月(yue)(yue)(yue)(yue)、8月(yue)(yue)(yue)(yue)、9月(yue)(yue)(yue)(yue)共4個月(yue)(yue)(yue)(yue)計發(fa),列入(ru)企業(ye)(ye)(ye)成本(ben)費用(yong)。防(fang)暑降(jiang)(jiang)溫(wen)(wen)費屬(shu)于勞動(dong)報(bao)酬的(de)組成部分,要求(qiu)現金發(fa)放,該(gai)發(fa)不發(fa)屬(shu)違法行(xing)為。根據《山東省(sheng)高(gao)溫(wen)(wen)天氣勞動(dong)保(bao)護辦法》(省(sheng)政(zheng)府令第239號)第二(er)十二(er)條規定:用(yong)人(ren)(ren)單位強(qiang)迫勞動(dong)者在高(gao)溫(wen)(wen)天氣期間工作(zuo)(zuo)的(de),或者未按(an)規定標準發(fa)放防(fang)暑降(jiang)(jiang)溫(wen)(wen)費的(de),由縣級以上人(ren)(ren)力資(zi)源社會(hui)保(bao)障部門責令改(gai)正;逾期未改(gai)正的(de),處以2000元(yuan)以上20000元(yuan)以下罰(fa)款;構成犯(fan)罪的(de),依(yi)法追究刑事責任。

在(zai)檢查過(guo)程中,對于存在(zai)問題的(de)用(yong)人(ren)單位(wei)(wei),將依法(fa)嚴(yan)肅處(chu)(chu)理。對違法(fa)情(qing)節嚴(yan)重(zhong)和拒不(bu)執(zhi)行處(chu)(chu)理決(jue)定的(de)用(yong)人(ren)單位(wei)(wei),在(zai)依法(fa)嚴(yan)肅處(chu)(chu)理的(de)同時,將通過(guo)新聞(wen)媒體進(jin)行曝光。
