中(zhong)秋節(jie)是國家法(fa)(fa)(fa)定節(jie)假(jia)日(ri),有些員工(gong)因單(dan)(dan)位生產原因無法(fa)(fa)(fa)安排(pai)休(xiu)息(xi),如果中(zhong)秋節(jie)不休(xiu),加(jia)班(ban)(ban)工(gong)資(zi)應(ying)(ying)該怎么算?人(ren)社局表(biao)示,9月(yue)15日(ri)中(zhong)秋節(jie)當(dang)天為(wei)法(fa)(fa)(fa)定節(jie)假(jia)日(ri),用(yong)人(ren)單(dan)(dan)位要求勞動者加(jia)班(ban)(ban)的,應(ying)(ying)向(xiang)勞動者支付(fu)(fu)(fu)3倍(bei)加(jia)班(ban)(ban)工(gong)資(zi);9月(yue)16日(ri)、9月(yue)17日(ri)為(wei)休(xiu)息(xi)日(ri),用(yong)人(ren)單(dan)(dan)位要求勞動者加(jia)班(ban)(ban)的,應(ying)(ying)當(dang)支付(fu)(fu)(fu)2倍(bei)加(jia)班(ban)(ban)工(gong)資(zi),用(yong)人(ren)單(dan)(dan)位不得以(yi)換休(xiu)和調休(xiu)的名義拒付(fu)(fu)(fu)加(jia)班(ban)(ban)費。
記者(zhe)了(le)解到(dao),根據(ju)國務院(yuan)辦公廳《關(guan)于(yu)(yu)2016年部分(fen)節(jie)假(jia)(jia)日(ri)(ri)(ri)(ri)安排(pai)的(de)通知》,2016年中秋節(jie)放假(jia)(jia)安排(pai)為(wei):9月(yue)(yue)15日(ri)(ri)(ri)(ri)至17日(ri)(ri)(ri)(ri)放假(jia)(jia)調休(xiu)(xiu),共3天;其中,9月(yue)(yue)15日(ri)(ri)(ri)(ri)(星(xing)期(qi)四)為(wei)法定節(jie)假(jia)(jia),9月(yue)(yue)16日(ri)(ri)(ri)(ri)、9月(yue)(yue)17日(ri)(ri)(ri)(ri)(星(xing)期(qi)五、星(xing)期(qi)六)為(wei)休(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri)(公休(xiu)(xiu)日(ri)(ri)(ri)(ri));9月(yue)(yue)18日(ri)(ri)(ri)(ri)(星(xing)期(qi)日(ri)(ri)(ri)(ri))正常上(shang)班(ban)(ban)。昨(zuo)天,記者(zhe)采訪市人(ren)社局相關(guan)部門工作人(ren)員(yuan)了(le)解到(dao),依據(ju)《關(guan)于(yu)(yu)職工全年月(yue)(yue)平均工作時(shi)間和(he)工資(zi)(zi)折算(suan)問(wen)題的(de)通知》和(he)《山東省企(qi)業工資(zi)(zi)支(zhi)(zhi)付(fu)規定》,9月(yue)(yue)15日(ri)(ri)(ri)(ri)中秋節(jie)當天為(wei)法定節(jie)假(jia)(jia)日(ri)(ri)(ri)(ri),用(yong)人(ren)單(dan)位(wei)要(yao)求勞動者(zhe)加班(ban)(ban)的(de),應(ying)向勞動者(zhe)支(zhi)(zhi)付(fu)不低于(yu)(yu)日(ri)(ri)(ri)(ri)或小時(shi)基數的(de)300%支(zhi)(zhi)付(fu)加班(ban)(ban)工資(zi)(zi),用(yong)人(ren)單(dan)位(wei)不得以換休(xiu)(xiu)和(he)調休(xiu)(xiu)的(de)名(ming)義(yi)拒付(fu)加班(ban)(ban)費;9月(yue)(yue)16日(ri)(ri)(ri)(ri)、9月(yue)(yue)17日(ri)(ri)(ri)(ri)為(wei)休(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri),用(yong)人(ren)單(dan)位(wei)要(yao)求勞動者(zhe)加班(ban)(ban)的(de),應(ying)當安排(pai)同等時(shi)間的(de)補(bu)休(xiu)(xiu),如(ru)不能安排(pai)補(bu)休(xiu)(xiu)的(de),用(yong)人(ren)單(dan)位(wei)應(ying)向勞動者(zhe)支(zhi)(zhi)付(fu)不低于(yu)(yu)日(ri)(ri)(ri)(ri)或者(zhe)小時(shi)基數的(de)200%支(zhi)(zhi)付(fu)加班(ban)(ban)工資(zi)(zi)。
中秋節(jie)加(jia)班費計(ji)算實例:以勞動(dong)者上(shang)一月(yue)份提供正常(chang)勞動(dong)所得實際工資(zi)扣除該月(yue)加(jia)班工資(zi)后(hou)的數(shu)額(e)1700元(yuan)(yuan)(yuan)為(wei)例,如果(guo)9月(yue)15日(ri)(ri)加(jia)班,用人單位(wei)支付加(jia)班工資(zi)不低(di)于(1700÷21.75)×300%,即234元(yuan)(yuan)(yuan),9月(yue)16日(ri)(ri)或9月(yue)17日(ri)(ri)安排加(jia)班,用人單位(wei)不能(neng)安排補(bu)休的,支付加(jia)班工資(zi)分別不低(di)于(1700÷21.75)×200%,即156元(yuan)(yuan)(yuan)。這(zhe)樣算來(lai),如果(guo)中秋節(jie)3天(tian)均加(jia)班,總計(ji)可(ke)多領546元(yuan)(yuan)(yuan)。
記者(zhe)在(zai)采(cai)訪時(shi)了解到,實行計(ji)件工(gong)(gong)(gong)資制的(de)(de)企業,應當(dang)依照國家或(huo)者(zhe)行業制定(ding)的(de)(de)勞(lao)(lao)動定(ding)額(e)(e)標準(zhun),結合本企業實際,經征求企業工(gong)(gong)(gong)會或(huo)者(zhe)職(zhi)工(gong)(gong)(gong)代表的(de)(de)意見(jian),合理確定(ding)勞(lao)(lao)動定(ding)額(e)(e)和計(ji)件單價。勞(lao)(lao)動者(zhe)完成計(ji)件定(ding)額(e)(e)后,企業安排其在(zai)法定(ding)標準(zhun)工(gong)(gong)(gong)作(zuo)時(shi)間以(yi)外工(gong)(gong)(gong)作(zuo)的(de)(de),應當(dang)按照以(yi)上(shang)政(zheng)策條款的(de)(de)規定(ding),分別按照不低于計(ji)件單位的(de)(de)200%、300%支(zhi)付(fu)(fu)加班工(gong)(gong)(gong)資。加班工(gong)(gong)(gong)資支(zhi)付(fu)(fu)應當(dang)在(zai)下一個工(gong)(gong)(gong)資發(fa)放日前(qian)發(fa)放給勞(lao)(lao)動者(zhe),如果企業拒不支(zhi)付(fu)(fu)的(de)(de),企業職(zhi)工(gong)(gong)(gong)可以(yi)向(xiang)當(dang)地勞(lao)(lao)動監察部(bu)門投訴。
加班工資計發基數
根據《山東(dong)省企(qi)業工(gong)(gong)資(zi)(zi)支付規定(ding)》:“企(qi)業應當(dang)按照勞(lao)(lao)動(dong)者上一(yi)月(yue)份(fen)提(ti)供正常(chang)勞(lao)(lao)動(dong)所得(de)實際工(gong)(gong)資(zi)(zi)扣(kou)除該月(yue)加班工(gong)(gong)資(zi)(zi)后的(de)數額確(que)(que)定(ding)(但(dan)不得(de)低于當(dang)地(di)最(zui)低工(gong)(gong)資(zi)(zi)標(biao)準);勞(lao)(lao)動(dong)者上一(yi)月(yue)份(fen)沒有(you)提(ti)供正常(chang)勞(lao)(lao)動(dong)的(de),按照向前順推至(zhi)其提(ti)供正常(chang)勞(lao)(lao)動(dong)月(yue)份(fen)所得(de)實際工(gong)(gong)資(zi)(zi)扣(kou)除該月(yue)加班工(gong)(gong)資(zi)(zi)后的(de)數額確(que)(que)定(ding)。”
加班工資適用范圍
根據《山東省企業(ye)(ye)工(gong)(gong)資(zi)支(zhi)付(fu)規(gui)定(ding)》:“經(jing)批準實(shi)行(xing)綜(zong)合計算(suan)工(gong)(gong)時(shi)工(gong)(gong)作制度(du)的(de)企業(ye)(ye),在(zai)綜(zong)合計算(suan)工(gong)(gong)時(shi)周期內實(shi)際工(gong)(gong)作時(shi)間(jian)(jian)超過法(fa)定(ding)標準工(gong)(gong)作時(shi)間(jian)(jian)的(de)部分應當視為加(jia)班(ban),用(yong)人(ren)單(dan)位按不(bu)(bu)低于勞動者(zhe)本人(ren)小時(shi)工(gong)(gong)資(zi)標準的(de)150%支(zhi)付(fu)加(jia)班(ban)工(gong)(gong)資(zi)。如果用(yong)人(ren)單(dan)位是在(zai)法(fa)定(ding)節(jie)假日安排勞動者(zhe)工(gong)(gong)作的(de),應按照(zhao)不(bu)(bu)低于勞動者(zhe)本人(ren)日或(huo)小時(shi)工(gong)(gong)資(zi)的(de)300%另行(xing)支(zhi)付(fu)加(jia)班(ban)工(gong)(gong)資(zi)。實(shi)行(xing)不(bu)(bu)定(ding)時(shi)工(gong)(gong)時(shi)制的(de)企業(ye)(ye),不(bu)(bu)適用(yong)有關加(jia)班(ban)工(gong)(gong)資(zi)的(de)規(gui)定(ding)。”
