人社局:中秋節為法定節假日 加班可獲3倍工資

中秋(qiu)節(jie)是國家(jia)法(fa)(fa)定節(jie)假(jia)日(ri),有些員(yuan)工(gong)因(yin)單(dan)位(wei)生(sheng)產(chan)原因(yin)無法(fa)(fa)安排休(xiu)息(xi),如果中秋(qiu)節(jie)不(bu)休(xiu),加(jia)班工(gong)資應該怎么算?人社局(ju)表示,9月(yue)15日(ri)中秋(qiu)節(jie)當(dang)天(tian)為法(fa)(fa)定節(jie)假(jia)日(ri),用(yong)人單(dan)位(wei)要求(qiu)勞動者加(jia)班的,應向(xiang)勞動者支付3倍加(jia)班工(gong)資;9月(yue)16日(ri)、9月(yue)17日(ri)為休(xiu)息(xi)日(ri),用(yong)人單(dan)位(wei)要求(qiu)勞動者加(jia)班的,應當(dang)支付2倍加(jia)班工(gong)資,用(yong)人單(dan)位(wei)不(bu)得(de)以換休(xiu)和調(diao)休(xiu)的名義(yi)拒付加(jia)班費。

記者(zhe)了解到(dao),根據(ju)國(guo)務院辦(ban)公(gong)(gong)廳《關(guan)于(yu)2016年(nian)部(bu)分節(jie)假日(ri)(ri)(ri)(ri)(ri)安(an)(an)(an)排(pai)的通知》,2016年(nian)中秋節(jie)放(fang)假安(an)(an)(an)排(pai)為(wei)(wei):9月(yue)15日(ri)(ri)(ri)(ri)(ri)至17日(ri)(ri)(ri)(ri)(ri)放(fang)假調休(xiu)(xiu)(xiu)(xiu),共3天;其(qi)中,9月(yue)15日(ri)(ri)(ri)(ri)(ri)(星(xing)(xing)期(qi)四(si))為(wei)(wei)法(fa)定節(jie)假,9月(yue)16日(ri)(ri)(ri)(ri)(ri)、9月(yue)17日(ri)(ri)(ri)(ri)(ri)(星(xing)(xing)期(qi)五、星(xing)(xing)期(qi)六(liu))為(wei)(wei)休(xiu)(xiu)(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri)(ri)(公(gong)(gong)休(xiu)(xiu)(xiu)(xiu)日(ri)(ri)(ri)(ri)(ri));9月(yue)18日(ri)(ri)(ri)(ri)(ri)(星(xing)(xing)期(qi)日(ri)(ri)(ri)(ri)(ri))正常上班(ban)。昨(zuo)天,記者(zhe)采訪市人(ren)(ren)社局相關(guan)部(bu)門工作人(ren)(ren)員(yuan)了解到(dao),依(yi)據(ju)《關(guan)于(yu)職(zhi)工全年(nian)月(yue)平(ping)均工作時間(jian)和工資(zi)折算(suan)問題的通知》和《山東省(sheng)企業工資(zi)支(zhi)(zhi)付(fu)規定》,9月(yue)15日(ri)(ri)(ri)(ri)(ri)中秋節(jie)當天為(wei)(wei)法(fa)定節(jie)假日(ri)(ri)(ri)(ri)(ri),用(yong)人(ren)(ren)單位(wei)要求(qiu)勞動(dong)者(zhe)加(jia)班(ban)的,應(ying)向勞動(dong)者(zhe)支(zhi)(zhi)付(fu)不低(di)于(yu)日(ri)(ri)(ri)(ri)(ri)或小時基(ji)數的300%支(zhi)(zhi)付(fu)加(jia)班(ban)工資(zi),用(yong)人(ren)(ren)單位(wei)不得(de)以換休(xiu)(xiu)(xiu)(xiu)和調休(xiu)(xiu)(xiu)(xiu)的名(ming)義拒付(fu)加(jia)班(ban)費;9月(yue)16日(ri)(ri)(ri)(ri)(ri)、9月(yue)17日(ri)(ri)(ri)(ri)(ri)為(wei)(wei)休(xiu)(xiu)(xiu)(xiu)息(xi)日(ri)(ri)(ri)(ri)(ri),用(yong)人(ren)(ren)單位(wei)要求(qiu)勞動(dong)者(zhe)加(jia)班(ban)的,應(ying)當安(an)(an)(an)排(pai)同(tong)等時間(jian)的補(bu)(bu)休(xiu)(xiu)(xiu)(xiu),如不能(neng)安(an)(an)(an)排(pai)補(bu)(bu)休(xiu)(xiu)(xiu)(xiu)的,用(yong)人(ren)(ren)單位(wei)應(ying)向勞動(dong)者(zhe)支(zhi)(zhi)付(fu)不低(di)于(yu)日(ri)(ri)(ri)(ri)(ri)或者(zhe)小時基(ji)數的200%支(zhi)(zhi)付(fu)加(jia)班(ban)工資(zi)。

中秋節(jie)加(jia)(jia)班(ban)(ban)(ban)費計(ji)算(suan)實(shi)例(li):以勞(lao)動者上一月(yue)份提供正常勞(lao)動所得(de)實(shi)際(ji)工(gong)(gong)資(zi)扣除(chu)該月(yue)加(jia)(jia)班(ban)(ban)(ban)工(gong)(gong)資(zi)后的(de)數額1700元(yuan)(yuan)為例(li),如(ru)果9月(yue)15日(ri)加(jia)(jia)班(ban)(ban)(ban),用人單位支付加(jia)(jia)班(ban)(ban)(ban)工(gong)(gong)資(zi)不低(di)于(1700÷21.75)×300%,即234元(yuan)(yuan),9月(yue)16日(ri)或9月(yue)17日(ri)安(an)排(pai)加(jia)(jia)班(ban)(ban)(ban),用人單位不能(neng)安(an)排(pai)補休(xiu)的(de),支付加(jia)(jia)班(ban)(ban)(ban)工(gong)(gong)資(zi)分別不低(di)于(1700÷21.75)×200%,即156元(yuan)(yuan)。這(zhe)樣算(suan)來(lai),如(ru)果中秋節(jie)3天均加(jia)(jia)班(ban)(ban)(ban),總計(ji)可多領(ling)546元(yuan)(yuan)。

記者在采訪時了解到,實(shi)行計件(jian)工(gong)資制的(de)(de)企(qi)(qi)業,應(ying)(ying)當依照國家(jia)或者行業制定(ding)(ding)的(de)(de)勞(lao)動(dong)定(ding)(ding)額標(biao)準(zhun),結(jie)合本企(qi)(qi)業實(shi)際,經征求(qiu)企(qi)(qi)業工(gong)會或者職工(gong)代表的(de)(de)意(yi)見,合理確定(ding)(ding)勞(lao)動(dong)定(ding)(ding)額和計件(jian)單(dan)(dan)價。勞(lao)動(dong)者完成計件(jian)定(ding)(ding)額后,企(qi)(qi)業安排其在法定(ding)(ding)標(biao)準(zhun)工(gong)作時間以(yi)(yi)外工(gong)作的(de)(de),應(ying)(ying)當按照以(yi)(yi)上(shang)政策條款的(de)(de)規定(ding)(ding),分別(bie)按照不低于計件(jian)單(dan)(dan)位的(de)(de)200%、300%支(zhi)(zhi)付(fu)(fu)加班工(gong)資。加班工(gong)資支(zhi)(zhi)付(fu)(fu)應(ying)(ying)當在下一個工(gong)資發放日(ri)前發放給(gei)勞(lao)動(dong)者,如(ru)果企(qi)(qi)業拒不支(zhi)(zhi)付(fu)(fu)的(de)(de),企(qi)(qi)業職工(gong)可以(yi)(yi)向當地勞(lao)動(dong)監察(cha)部門投訴。

加班工資計發基數

根據(ju)《山東省(sheng)企(qi)業(ye)工(gong)資(zi)(zi)支付(fu)規(gui)定(ding)(ding)》:“企(qi)業(ye)應(ying)當按照勞動者上一月(yue)份提(ti)供正常(chang)(chang)勞動所(suo)得(de)實(shi)際工(gong)資(zi)(zi)扣除該(gai)月(yue)加班工(gong)資(zi)(zi)后的數(shu)額確定(ding)(ding)(但(dan)不得(de)低于當地最低工(gong)資(zi)(zi)標(biao)準);勞動者上一月(yue)份沒(mei)有提(ti)供正常(chang)(chang)勞動的,按照向前順推至其(qi)提(ti)供正常(chang)(chang)勞動月(yue)份所(suo)得(de)實(shi)際工(gong)資(zi)(zi)扣除該(gai)月(yue)加班工(gong)資(zi)(zi)后的數(shu)額確定(ding)(ding)。”

加班工資適用范圍

根據《山東省企業(ye)工(gong)(gong)(gong)資(zi)(zi)(zi)支付規定(ding)》:“經批準實(shi)行綜(zong)合計(ji)(ji)算工(gong)(gong)(gong)時(shi)工(gong)(gong)(gong)作(zuo)制(zhi)度的(de)企業(ye),在(zai)綜(zong)合計(ji)(ji)算工(gong)(gong)(gong)時(shi)周(zhou)期內實(shi)際工(gong)(gong)(gong)作(zuo)時(shi)間超過法(fa)定(ding)標準工(gong)(gong)(gong)作(zuo)時(shi)間的(de)部分應(ying)當(dang)視為加班,用(yong)人單(dan)(dan)位按不低于(yu)勞(lao)(lao)動者(zhe)本人小時(shi)工(gong)(gong)(gong)資(zi)(zi)(zi)標準的(de)150%支付加班工(gong)(gong)(gong)資(zi)(zi)(zi)。如果用(yong)人單(dan)(dan)位是在(zai)法(fa)定(ding)節假(jia)日安(an)排勞(lao)(lao)動者(zhe)工(gong)(gong)(gong)作(zuo)的(de),應(ying)按照不低于(yu)勞(lao)(lao)動者(zhe)本人日或小時(shi)工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)300%另行支付加班工(gong)(gong)(gong)資(zi)(zi)(zi)。實(shi)行不定(ding)時(shi)工(gong)(gong)(gong)時(shi)制(zhi)的(de)企業(ye),不適用(yong)有關(guan)加班工(gong)(gong)(gong)資(zi)(zi)(zi)的(de)規定(ding)。”
