昨天,記者(zhe)從山東省人力(li)資(zi)源和社會保障廳獲悉,省人民(min)政府辦(ban)公廳發(fa)布了《關于貫徹國(guo)辦(ban)發(fa)〔2016〕1號文件(jian)全面治理拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)問題的(de)(de)實施意(yi)(yi)見(jian)》(以下簡(jian)稱《意(yi)(yi)見(jian)》),《意(yi)(yi)見(jian)》提出所有施工(gong)(gong)企業,不得采(cai)取每月支付(fu)生活(huo)費、過后(hou)結算工(gong)(gong)資(zi)的(de)(de)方式支付(fu)工(gong)(gong)資(zi)。到2020年(nian),形成制(zhi)度(du)完備(bei)、責任落實、監管有力(li)的(de)(de)治理格局,使拖欠農(nong)民(min)工(gong)(gong)工(gong)(gong)資(zi)問題得到根本(ben)(ben)遏制(zhi),努(nu)力(li)實現(xian)基(ji)本(ben)(ben)無拖欠。
五大行業為治理重點
記(ji)者(zhe)了解到,省人民(min)(min)政(zheng)(zheng)府辦公廳這次發布的(de)《意見》,以(yi)建筑市(shi)政(zheng)(zheng)、交通、水利等(deng)工(gong)程(cheng)建設(she)領域和勞動密集型加工(gong)制造、餐飲服務等(deng)易(yi)發生拖欠(qian)工(gong)資問(wen)題的(de)行業為(wei)重點,健全源頭(tou)預(yu)防(fang)、動態監管、失信懲戒相(xiang)結合的(de)制度(du)保障體系(xi),完善市(shi)場主體自律、政(zheng)(zheng)府依法監管、社(she)會協同監督、司法聯(lian)動懲處的(de)工(gong)作(zuo)體系(xi)。到2020年,形成制度(du)完備、責(ze)任落實(shi)、監管有力的(de)治理格局(ju),從根(gen)本上解決拖欠(qian)農(nong)民(min)(min)工(gong)工(gong)資問(wen)題,努力實(shi)現基(ji)本無(wu)拖欠(qian)。
措施
A、如有拖欠誰來清償
《意見(jian)》明確指出,因建(jian)設單(dan)位存在(zai)違(wei)法發包(bao)(bao)(bao)、施工(gong)總承包(bao)(bao)(bao)企(qi)業(ye)和(he)(he)分(fen)包(bao)(bao)(bao)企(qi)業(ye)存在(zai)轉包(bao)(bao)(bao)及(ji)違(wei)法分(fen)包(bao)(bao)(bao)行(xing)為,造成農民(min)工(gong)工(gong)資被拖欠的,由建(jian)設單(dan)位、施工(gong)總承包(bao)(bao)(bao)企(qi)業(ye)和(he)(he)分(fen)包(bao)(bao)(bao)企(qi)業(ye)承擔清償農民(min)工(gong)工(gong)資的責任。
因建設(she)單位(wei)或施(shi)(shi)工(gong)(gong)(gong)總(zong)承包(bao)企業(ye)未按照施(shi)(shi)工(gong)(gong)(gong)進度(du)和合同(tong)約定支(zhi)付(fu)工(gong)(gong)(gong)程款,致使分(fen)包(bao)企業(ye)拖欠農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)的,由(you)建設(she)單位(wei)或者施(shi)(shi)工(gong)(gong)(gong)總(zong)承包(bao)企業(ye)以應支(zhi)付(fu)而(er)未支(zhi)付(fu)的工(gong)(gong)(gong)程款為限,先行墊付(fu)農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)。由(you)政府(fu)投資(zi)、招(zhao)商(shang)引資(zi)及(ji)舊村改造工(gong)(gong)(gong)程的項目,因拖欠工(gong)(gong)(gong)程款引發的欠薪,由(you)政府(fu)負(fu)直接責(ze)(ze)任并帶頭清(qing)償(chang),逾期未清(qing)償(chang)的,要追究政府(fu)主(zhu)要負(fu)責(ze)(ze)人(ren)和分(fen)管負(fu)責(ze)(ze)人(ren)責(ze)(ze)任。
B、全面實施“一書兩金一卡”
《意(yi)見》要求各地(di)區全面(mian)實施“一(yi)書(shu)兩金一(yi)卡(ka)”制度。
“一書”,指(zhi)的是簽(qian)訂(ding)防(fang)范(fan)拖(tuo)欠農(nong)民工(gong)工(gong)資(zi)目標責任書。
“兩(liang)金(jin)(jin)”指(zhi)的(de)是完善工資保證金(jin)(jin)制度和欠(qian)薪應急周轉(zhuan)金(jin)(jin)制度。
“一卡”是指全面(mian)推行(xing)農(nong)民工(gong)(gong)工(gong)(gong)資支付銀(yin)行(xing)卡制度。在建(jian)筑(zhu)市政、交通、水利(li)等(deng)工(gong)(gong)程建(jian)設領域(yu),所有用工(gong)(gong)單位都(dou)要通過銀(yin)行(xing)卡向(xiang)農(nong)民工(gong)(gong)發放(fang)工(gong)(gong)資。
管理
A、開設農民工工資專用賬戶
施工(gong)(gong)(gong)總承包企(qi)業應(ying)分解工(gong)(gong)(gong)程(cheng)價款(kuan)中的人工(gong)(gong)(gong)費(fei)用(yong),在(zai)工(gong)(gong)(gong)程(cheng)項目所在(zai)地(di)銀行開設農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)(勞務(wu)費(fei))專用(yong)賬戶,專項用(yong)于支(zhi)付農民工(gong)(gong)(gong)工(gong)(gong)(gong)資(zi)。專用(yong)賬戶應(ying)向(xiang)人力資(zi)源社(she)會保障和住房(fang)城鄉建設、交(jiao)通運輸、水(shui)利等行業主管部(bu)門備案(an),并委托(tuo)開戶銀行負(fu)責日(ri)常監管,確保專款(kuan)專用(yong)。
B、農民工用工實名制管理
施工(gong)總承包(bao)企業(ye)和工(gong)程項目部(bu)應配(pei)備勞資(zi)專管員,留存每名農民工(gong)身份證、勞動合同書等復(fu)印(yin)件;健全農民工(gong)進退場、考勤計量、工(gong)資(zi)支(zhi)付(fu)等管理臺賬(zhang),逐步實現信息(xi)化實名制管理。勞務(wu)、分包(bao)企業(ye)負(fu)責為招(zhao)用的農民工(gong)申(shen)辦銀行(xing)個(ge)人工(gong)資(zi)賬(zhang)戶并(bing)辦理實名制工(gong)資(zi)支(zhi)付(fu)銀行(xing)卡(ka)(ka),并(bing)負(fu)責將工(gong)資(zi)卡(ka)(ka)發放至農民工(gong)本人手(shou)中(zhong)。
查處
A、綠色通道處理欠薪案件
充分(fen)發揮(hui)基層勞(lao)動爭議(yi)調解等組織的作用,強化(hua)調裁(cai)銜接,落實調解建(jian)議(yi)書、委托(tuo)調解的仲(zhong)(zhong)裁(cai)審查確認(ren)等制度,引導(dao)農民工就地就近解決工資爭議(yi)。勞(lao)動人事(shi)爭議(yi)仲(zhong)(zhong)裁(cai)機構對農民工因拖欠工資申請仲(zhong)(zhong)裁(cai)的爭議(yi)案件(jian)開(kai)辟(pi)“綠(lv)色通道”,優先(xian)受理、優先(xian)開(kai)庭、及時裁(cai)決、快速結(jie)案。對集體欠薪爭議(yi)或涉及金額(e)較大的欠薪爭議(yi)案件(jian)要(yao)掛牌督辦。
B、聯合懲戒欠薪失信行為
建(jian)立(li)企(qi)(qi)業(ye)勞(lao)動(dong)(dong)保障守法(fa)誠信評價和重大勞(lao)動(dong)(dong)保障違法(fa)行(xing)為(wei)社會公布制度,將勞(lao)動(dong)(dong)用工、工資(zi)支付情況作為(wei)企(qi)(qi)業(ye)誠信評價的(de)重要依(yi)據,納入(ru)全(quan)省社會信用體系建(jian)設。加強(qiang)對企(qi)(qi)業(ye)失信行(xing)為(wei)的(de)部門協同(tong)監管和聯合懲戒,對拖欠工資(zi)的(de)失信企(qi)(qi)業(ye),由有關部門在政府(fu)資(zi)金(jin)支持、政府(fu)采(cai)購、招投標、生產(chan)許可、融(rong)資(zi)貸款(kuan)、市場準(zhun)入(ru)等方面依(yi)法(fa)依(yi)規(gui)予(yu)以限制,使(shi)失信企(qi)(qi)業(ye)“一處失信、處處受限”。
