山東省長島縣積極探索農民工工資支付長效機制

近年來,長島縣人社局不斷解放思想,創新服務,提高管理效能,初步建立起以規范勞動用工行為、完善農民工工資保證金制度、健全違法行為預防預警和多部門綜合治理的長效機制,有力保障了建設領域農民工的合法權益。

一是暢(chang)通投(tou)訴(su)(su)渠道。堅(jian)持暢(chang)通投(tou)訴(su)(su)舉報(bao)(bao)渠道與加強主動執法檢查(cha)相結合,公(gong)開公(gong)布(bu)勞動保(bao)障監察機構(gou)投(tou)訴(su)(su)電話,對拖欠農民工(gong)工(gong)資(zi)的各類(lei)舉報(bao)(bao)投(tou)訴(su)(su),做到“有報(bao)(bao)必接、有案必查(cha)、有查(cha)必結”。各行業(ye)主管部(bu)門均(jun)建立(li)(li)了(le)(le)24小時值班制度,向社(she)會公(gong)布(bu)了(le)(le)投(tou)訴(su)(su)舉報(bao)(bao)公(gong)開電話。建立(li)(li)信息(xi)互通、資(zi)源共享(xiang)的投(tou)訴(su)(su)受理服務(wu)平臺(tai)。同時引導農民工(gong)用理性(xing)、合法手(shou)段維護自身權益(yi)。

二是健全違法(fa)行(xing)為(wei)預(yu)防(fang)預(yu)警和多部(bu)門(men)(men)綜(zong)(zong)合治理(li)(li)機(ji)制(zhi)。制(zhi)定《長島縣處理(li)(li)拖欠農民工(gong)工(gong)資(zi)群體性(xing)(xing)突發事件應急處置預(yu)案(an)》,強化部(bu)門(men)(men)之間(jian)的(de)(de)橫向聯合機(ji)制(zhi),積極(ji)協(xie)調主管部(bu)門(men)(men)對不(bu)(bu)(bu)能提(ti)供農民工(gong)工(gong)資(zi)保證(zheng)金繳(jiao)費憑證(zheng)的(de)(de)建設單位和施(shi)工(gong)企(qi)(qi)業,不(bu)(bu)(bu)予辦理(li)(li)施(shi)工(gong)許可證(zheng)。對不(bu)(bu)(bu)同企(qi)(qi)業實施(shi)不(bu)(bu)(bu)同強度、不(bu)(bu)(bu)同頻率的(de)(de)差異性(xing)(xing)監管。對信用(yong)度低(di)、常出問題的(de)(de)企(qi)(qi)業嚴防(fang)死守,嚴格(ge)(ge)懲戒;對嚴重(zhong)拖欠農民工(gong)工(gong)資(zi),造(zao)成嚴重(zhong)不(bu)(bu)(bu)良影(ying)響的(de)(de)企(qi)(qi)業,實行(xing)承包資(zi)格(ge)(ge)一票否決。做到違法(fa)問題信息共享、責任(ren)共擔、綜(zong)(zong)合治理(li)(li)、標(biao)本兼(jian)治,形(xing)成治理(li)(li)農民工(gong)工(gong)資(zi)的(de)(de)綜(zong)(zong)合治理(li)(li)格(ge)(ge)局(ju)。

三是強化(hua)建(jian)(jian)筑工(gong)(gong)(gong)(gong)地管(guan)(guan)理(li),狠抓工(gong)(gong)(gong)(gong)作落實。在建(jian)(jian)筑施(shi)(shi)工(gong)(gong)(gong)(gong)企業(ye)中全面推行(xing)勞(lao)(lao)動用工(gong)(gong)(gong)(gong)“一書(shu)兩金一卡(ka)”制(zhi)度(du)(即防范拖欠工(gong)(gong)(gong)(gong)資(zi)目標(biao)責任書(shu)、農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)保證(zheng)金和欠薪應急周轉金、農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)支(zhi)付銀行(xing)卡(ka)制(zhi)度(du))。建(jian)(jian)立每季度(du)督(du)(du)查制(zhi)度(du),會同(tong)有關行(xing)業(ye)主管(guan)(guan)部(bu)門深入建(jian)(jian)筑施(shi)(shi)工(gong)(gong)(gong)(gong)企業(ye)督(du)(du)查政策落實情(qing)況,今年(nian)已先后開展兩次(ci)保障(zhang)農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)支(zhi)付專項督(du)(du)查活動,向企業(ye)發放(fang)(fang)《建(jian)(jian)設施(shi)(shi)工(gong)(gong)(gong)(gong)企業(ye)保障(zhang)農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)支(zhi)付工(gong)(gong)(gong)(gong)作需知》明白紙,通(tong)過采取現場查看職(zhi)工(gong)(gong)(gong)(gong)花名(ming)冊、考勤表、勞(lao)(lao)動合同(tong)、工(gong)(gong)(gong)(gong)資(zi)發放(fang)(fang)表以及(ji)勞(lao)(lao)資(zi)專管(guan)(guan)員、防范拖欠農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)目標(biao)責任書(shu)、工(gong)(gong)(gong)(gong)資(zi)保證(zheng)金、農(nong)民(min)工(gong)(gong)(gong)(gong)工(gong)(gong)(gong)(gong)資(zi)與工(gong)(gong)(gong)(gong)程(cheng)款(kuan)分(fen)賬戶(hu)管(guan)(guan)理(li)、銀行(xing)卡(ka)等制(zhi)度(du)落實情(qing)況,對(dui)督(du)(du)查出現的(de)政策執(zhi)行(xing)不(bu)(bu)力的(de)建(jian)(jian)筑施(shi)(shi)工(gong)(gong)(gong)(gong)企業(ye)現場指出存(cun)在的(de)問題并責令限(xian)期整(zheng)改,要(yao)求各行(xing)業(ye)主管(guan)(guan)部(bu)門及(ji)時(shi)督(du)(du)促企業(ye)認真整(zheng)改,確保上級政策規定落實到位(wei),并下發了三份督(du)(du)查通(tong)報。嚴格執(zhi)行(xing)黑(hei)名(ming)單制(zhi)度(du),對(dui)惡(e)意(yi)拖欠極不(bu)(bu)配合的(de)單位(wei)要(yao)及(ji)時(shi)列(lie)入黑(hei)名(ming)單。
