辭職未提前30天通知單位,被扣工資合法嗎?

我要離(li)職(zhi)了,但是公(gong)司通知要提(ti)前(qian)30天提(ti)出,要不然(ran)就要扣工資(zi),這樣做合法嗎?

《勞(lao)動(dong)(dong)法》第(di)3條(tiao)規(gui)定,勞(lao)動(dong)(dong)者(zhe)享有(you)取得勞(lao)動(dong)(dong)報酬的(de)權利。《工資(zi)(zi)支付暫行規(gui)定》第(di)9條(tiao)規(gui)定,勞(lao)動(dong)(dong)關系(xi)雙方(fang)依(yi)法解除或終止勞(lao)動(dong)(dong)合同時(shi)(shi),用人單位(wei)應在解除或終止勞(lao)動(dong)(dong)合同時(shi)(shi)一(yi)次付清勞(lao)動(dong)(dong)者(zhe)工資(zi)(zi)。勞(lao)動(dong)(dong)者(zhe)提供了(le)勞(lao)動(dong)(dong),用人單位(wei)應當(dang)支付勞(lao)動(dong)(dong)報酬,解除勞(lao)動(dong)(dong)關系(xi)時(shi)(shi)雙方(fang)應當(dang)結清工資(zi)(zi)。工資(zi)(zi)作為正(zheng)常勞(lao)動(dong)(dong)所(suo)得,在無(wu)法定情形下,用人單位(wei)無(wu)權扣除工資(zi)(zi)。
