我剛剛進(jin)入職(zhi)場,現(xian)在想咨詢一下,請問綜合計(ji)算(suan)工(gong)時制度的加班費如何計(ji)算(suan)?

按照勞(lao)動(dong)部《關(guan)于企業(ye)實(shi)行不(bu)定時(shi)工(gong)(gong)作制(zhi)和綜合(he)計(ji)(ji)算(suan)(suan)工(gong)(gong)時(shi)工(gong)(gong)作制(zhi)的(de)審批辦法(fa)》和《關(guan)于職工(gong)(gong)工(gong)(gong)作時(shi)間有關(guan)問題的(de)復函》規(gui)定,經批準實(shi)行綜合(he)計(ji)(ji)算(suan)(suan)工(gong)(gong)時(shi)工(gong)(gong)作制(zhi)的(de)企業(ye),在(zai)綜合(he)計(ji)(ji)算(suan)(suan)周(zhou)期內的(de)總(zong)實(shi)際工(gong)(gong)作時(shi)間不(bu)應超過(guo)總(zong)法(fa)定標準工(gong)(gong)作時(shi)間,超過(guo)部分應視為延長工(gong)(gong)作時(shi)間并(bing)按《勞(lao)動(dong)法(fa)》第(di)44第(di)1款(kuan)的(de)規(gui)定支付工(gong)(gong)資報酬(chou),其中法(fa)定休假日安排勞(lao)動(dong)者工(gong)(gong)作的(de),按《勞(lao)動(dong)法(fa)》第(di)44第(di)3款(kuan)的(de)規(gui)定支付工(gong)(gong)資報酬(chou)。而(er)且,延長工(gong)(gong)作時(shi)間的(de)小時(shi)數平(ping)均(jun)每月不(bu)得超過(guo)36小時(shi)。
