答(da) 勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)有下列情(qing)形(xing)之一(yi)的(de),用(yong)人單(dan)位(wei)(wei)(wei)(wei)可以解除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同: (一(yi))在試用(yong)期間被證明(ming)不(bu)符(fu)合(he)錄用(yong)條件的(de); (二(er))嚴重違反勞(lao)(lao)(lao)動(dong)(dong)(dong)紀律(lv)或(huo)(huo)者(zhe)用(yong)人單(dan)位(wei)(wei)(wei)(wei)規章制度(du)的(de); (三(san))嚴重失職(zhi),營私舞弊,對用(yong)人單(dan)位(wei)(wei)(wei)(wei)利益造成重大(da)損害的(de); (四)被依(yi)法(fa)追(zhui)究(jiu)刑事(shi)責任的(de)。 有下列情(qing)形(xing)之一(yi)的(de),用(yong)人單(dan)位(wei)(wei)(wei)(wei)可以解除勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同,但是應當提前三(san)十日以書面形(xing)式通(tong)知勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)本人: (一(yi))勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)患病或(huo)(huo)者(zhe)非因工(gong)負傷,醫療期滿后,不(bu)能從事(shi)原工(gong)作也不(bu)能從事(shi)由用(yong)人單(dan)位(wei)(wei)(wei)(wei)另行安排的(de)工(gong)作的(de); (二(er))勞(lao)(lao)(lao)動(dong)(dong)(dong)者(zhe)不(bu)能勝任工(gong)作,經過培訓或(huo)(huo)者(zhe)調整工(gong)作崗位(wei)(wei)(wei)(wei),仍不(bu)能勝任工(gong)作的(de); (三(san))勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同訂立時所(suo)依(yi)據的(de)客(ke)觀情(qing)況(kuang)發生重大(da)變(bian)化,致(zhi)使(shi)原勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同無法(fa)履行,經當事(shi)人協商不(bu)能就變(bian)更勞(lao)(lao)(lao)動(dong)(dong)(dong)合(he)同達成協議的(de)。
