答 勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)有下列情(qing)形(xing)之一(yi)(yi)的(de)(de),用(yong)(yong)(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)可以解除(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong): (一(yi)(yi))在試用(yong)(yong)(yong)(yong)(yong)(yong)期間被(bei)證(zheng)明不(bu)(bu)符合(he)錄用(yong)(yong)(yong)(yong)(yong)(yong)條件(jian)的(de)(de); (二(er))嚴(yan)(yan)重(zhong)違反勞(lao)(lao)(lao)動(dong)(dong)紀律或者(zhe)(zhe)(zhe)用(yong)(yong)(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)規章(zhang)制度的(de)(de); (三(san))嚴(yan)(yan)重(zhong)失(shi)職(zhi),營私(si)舞弊,對(dui)用(yong)(yong)(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)利益造成重(zhong)大(da)損害的(de)(de); (四)被(bei)依法追究刑(xing)事責(ze)任(ren)(ren)的(de)(de)。 有下列情(qing)形(xing)之一(yi)(yi)的(de)(de),用(yong)(yong)(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)可以解除(chu)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong),但是應當提前(qian)三(san)十日以書面(mian)形(xing)式通(tong)知勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)本人(ren)(ren)(ren)(ren): (一(yi)(yi))勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)患病或者(zhe)(zhe)(zhe)非因工負(fu)傷(shang),醫療(liao)期滿后,不(bu)(bu)能(neng)從事原(yuan)工作(zuo)(zuo)(zuo)也不(bu)(bu)能(neng)從事由用(yong)(yong)(yong)(yong)(yong)(yong)人(ren)(ren)(ren)(ren)單(dan)位(wei)(wei)另(ling)行安排的(de)(de)工作(zuo)(zuo)(zuo)的(de)(de); (二(er))勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)不(bu)(bu)能(neng)勝(sheng)任(ren)(ren)工作(zuo)(zuo)(zuo),經(jing)過培訓或者(zhe)(zhe)(zhe)調(diao)整工作(zuo)(zuo)(zuo)崗位(wei)(wei),仍不(bu)(bu)能(neng)勝(sheng)任(ren)(ren)工作(zuo)(zuo)(zuo)的(de)(de); (三(san))勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)訂立時所依據的(de)(de)客觀(guan)情(qing)況發(fa)生重(zhong)大(da)變(bian)化,致使原(yuan)勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)無法履行,經(jing)當事人(ren)(ren)(ren)(ren)協(xie)商(shang)不(bu)(bu)能(neng)就變(bian)更勞(lao)(lao)(lao)動(dong)(dong)合(he)同(tong)(tong)(tong)達(da)成協(xie)議的(de)(de)。
