辭職未休年休假能否要求補償?

打算(suan)辭職,去年(nian)沒有請過病事(shi)假,也(ye)未(wei)休年(nian)休假,我能否要求(qiu)企業給付未(wei)休年(nian)休假的補(bu)償?

你可以要求企(qi)業(ye)支付(fu)未休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)的(de)補(bu)償(chang)工(gong)資。《職工(gong)帶薪(xin)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)條例》規定:機關(guan)、團(tuan)體(ti)、企(qi)業(ye)、事業(ye)單位、民辦(ban)非企(qi)業(ye)單位、有雇工(gong)的(de)個體(ti)工(gong)商戶(hu)等單位的(de)職工(gong)連(lian)續工(gong)作1年(nian)(nian)(nian)以上的(de),享受(shou)帶薪(xin)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)。病假(jia)(jia)(jia)超過一(yi)定天數影響享受(shou)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)。經(jing)職工(gong)同意(yi)不安(an)排(pai)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)或者安(an)排(pai)職工(gong)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天數少于應休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天數,應當在本(ben)年(nian)(nian)(nian)度內對職工(gong)應休(xiu)(xiu)未休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)天數,按照其日工(gong)資收入(ru)的(de)300%支付(fu)未休(xiu)(xiu)年(nian)(nian)(nian)休(xiu)(xiu)假(jia)(jia)(jia)工(gong)資報酬(自愿放棄休(xiu)(xiu)假(jia)(jia)(jia)的(de)除外),其中(zhong)包(bao)含用人(ren)單位支付(fu)職工(gong)正常工(gong)作期(qi)間的(de)工(gong)資收入(ru)。
