最近公(gong)司讓我(wo)在雙休日(ri)外(wai)派(pai)出(chu)差,想咨詢(xun)一下,雙休日(ri)外(wai)派(pai)出(chu)差算(suan)(suan)不(bu)算(suan)(suan)加班?

雙休(xiu)(xiu)日(ri)一般為勞動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)休(xiu)(xiu)息(xi)(xi)的(de)時(shi)間(jian),雙休(xiu)(xiu)日(ri)出(chu)(chu)(chu)差(cha)(cha)是(shi)否(fou)屬于加(jia)班(ban)(ban)(ban),關鍵(jian)要看勞動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)是(shi)否(fou)提(ti)供(gong)了勞動(dong)(dong)(dong)(dong)(dong)——如(ru)(ru)出(chu)(chu)(chu)差(cha)(cha)期(qi)間(jian)恰逢雙休(xiu)(xiu)日(ri),勞動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)在此期(qi)間(jian)提(ti)供(gong)了勞動(dong)(dong)(dong)(dong)(dong)的(de),應為加(jia)班(ban)(ban)(ban);如(ru)(ru)出(chu)(chu)(chu)差(cha)(cha)期(qi)間(jian)恰逢雙休(xiu)(xiu)日(ri),勞動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)沒有提(ti)供(gong)勞動(dong)(dong)(dong)(dong)(dong),只(zhi)是(shi)在休(xiu)(xiu)息(xi)(xi)和游玩(wan)的(de),則不(bu)算加(jia)班(ban)(ban)(ban)。如(ru)(ru)果(guo)勞動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)雙休(xiu)(xiu)日(ri)出(chu)(chu)(chu)差(cha)(cha)已被用人單位(wei)(wei)認定(ding)為加(jia)班(ban)(ban)(ban),且用人單位(wei)(wei)不(bu)能安排補(bu)(bu)休(xiu)(xiu)的(de),則應依法(fa)支付加(jia)班(ban)(ban)(ban)費。出(chu)(chu)(chu)差(cha)(cha)津貼(tie)、出(chu)(chu)(chu)差(cha)(cha)補(bu)(bu)貼(tie)并(bing)不(bu)是(shi)法(fa)定(ding)的(de)加(jia)班(ban)(ban)(ban)費,也不(bu)包含有加(jia)班(ban)(ban)(ban)費的(de)內容(rong),因(yin)此用人單位(wei)(wei)不(bu)能用出(chu)(chu)(chu)差(cha)(cha)津貼(tie)、出(chu)(chu)(chu)差(cha)(cha)補(bu)(bu)貼(tie)來抵做全部或一部分加(jia)班(ban)(ban)(ban)費。
