加班不給加班費用調休代替合法嗎?

我們公司最(zui)近讓我們加班(ban)了,想咨詢(xun)一下,加班(ban)不(bu)給加班(ban)費(fei)用(yong)調(diao)休代替(ti)合法(fa)嗎?

1、正常(chang)工(gong)(gong)作日延長工(gong)(gong)作時(shi)(shi)間(jian)進(jin)行加(jia)(jia)(jia)班(ban)的(de),應當(dang)支(zhi)(zhi)(zhi)付(fu)(fu)不(bu)低于工(gong)(gong)資的(de)150%的(de)工(gong)(gong)資報酬(chou)。該加(jia)(jia)(jia)班(ban)時(shi)(shi)間(jian)不(bu)可(ke)以(yi)用(yong)調(diao)休(xiu)處理,只能支(zhi)(zhi)(zhi)付(fu)(fu)相應的(de)工(gong)(gong)資報酬(chou)。 2、安(an)排周(zhou)末(mo)加(jia)(jia)(jia)班(ban)的(de),用(yong)人(ren)(ren)單(dan)(dan)位(wei)可(ke)以(yi)安(an)排調(diao)休(xiu)代替。但(dan)如果(guo)用(yong)人(ren)(ren)單(dan)(dan)位(wei)無法安(an)排調(diao)休(xiu)的(de),應當(dang)支(zhi)(zhi)(zhi)付(fu)(fu)不(bu)低于工(gong)(gong)資的(de)200%的(de)工(gong)(gong)資報酬(chou)。 3、法定節假日加(jia)(jia)(jia)班(ban)的(de),該時(shi)(shi)段的(de)加(jia)(jia)(jia)班(ban)即使后(hou)期安(an)排員(yuan)工(gong)(gong)調(diao)休(xiu),用(yong)人(ren)(ren)單(dan)(dan)位(wei)也應支(zhi)(zhi)(zhi)付(fu)(fu)不(bu)低于工(gong)(gong)資的(de)300%的(de)工(gong)(gong)資報酬(chou)。
