答 《勞(lao)(lao)(lao)動(dong)合(he)同(tong)法》第18條規(gui)(gui)定(ding):“勞(lao)(lao)(lao)動(dong)合(he)同(tong)對勞(lao)(lao)(lao)動(dong)報酬和勞(lao)(lao)(lao)動(dong)條件等標準約定(ding)不明確,引發(fa)爭(zheng)議的,用人單位(wei)與勞(lao)(lao)(lao)動(dong)者可以重新協商;協商不成的,適(shi)用集(ji)(ji)體(ti)合(he)同(tong)規(gui)(gui)定(ding);沒有(you)集(ji)(ji)體(ti)合(he)同(tong)或(huo)者集(ji)(ji)體(ti)合(he)同(tong)未規(gui)(gui)定(ding)勞(lao)(lao)(lao)動(dong)報酬的,實行同(tong)工同(tong)酬;沒有(you)集(ji)(ji)體(ti)合(he)同(tong)或(huo)者集(ji)(ji)體(ti)合(he)同(tong)未規(gui)(gui)定(ding)勞(lao)(lao)(lao)動(dong)條件等標準的,適(shi)用國家有(you)關規(gui)(gui)定(ding)。”
