《勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)法》第二十一條規定:“在試用(yong)(yong)期(qi)中,除(chu)有(you)證(zheng)(zheng)據證(zheng)(zheng)明勞(lao)動(dong)(dong)(dong)(dong)者(zhe)不符(fu)合(he)(he)(he)錄用(yong)(yong)條件外,用(yong)(yong)人單(dan)位不得解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong),用(yong)(yong)人單(dan)位在試用(yong)(yong)期(qi)解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)的,應當向勞(lao)動(dong)(dong)(dong)(dong)者(zhe)說(shuo)明理由。”在這種情況(kuang)下(xia),用(yong)(yong)人單(dan)位解(jie)除(chu)勞(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)無須支(zhi)付經(jing)濟補償金(jin)。用(yong)(yong)人單(dan)位若單(dan)方提出(chu)解(jie)除(chu)合(he)(he)(he)同(tong),或者(zhe)企業本身經(jing)濟性裁員等(deng)重(zhong)大變動(dong)(dong)(dong)(dong)而辭(ci)退(tui)試用(yong)(yong)期(qi)員工的話(hua),是(shi)需要提前三(san)十日(ri)通知并(bing)給相應補償金(jin)。
