放棄哺乳時間是否要補發工資啊?

我現在(zai)處(chu)在(zai)哺乳(ru)期(qi)期(qi)間(jian),想(xiang)咨詢一下,放(fang)棄哺乳(ru)時間(jian)是否要補發工資啊?

答(da) 雖然《女職工(gong)(gong)(gong)勞動(dong)(dong)保護(hu)規定(ding)(ding)》明確(que)規定(ding)(ding)了女職工(gong)(gong)(gong)在生育后嬰(ying)兒一周歲以(yi)內,單(dan)位(wei)應(ying)照顧其在每(mei)班勞動(dong)(dong)時(shi)(shi)(shi)間內授(shou)(shou)(shou)乳(ru)兩(liang)次(ci),每(mei)次(ci)單(dan)胎授(shou)(shou)(shou)乳(ru)時(shi)(shi)(shi)間為(wei)三(san)十分鐘,亦可將兩(liang)次(ci)授(shou)(shou)(shou)乳(ru)時(shi)(shi)(shi)間合并(bing)使用,并(bing)且授(shou)(shou)(shou)乳(ru)時(shi)(shi)(shi)間及在本單(dan)位(wei)內授(shou)(shou)(shou)乳(ru)往返(fan)時(shi)(shi)(shi)間,都(dou)應(ying)算作勞動(dong)(dong)時(shi)(shi)(shi)間。但(dan)法律并(bing)未規定(ding)(ding)在用人單(dan)位(wei)拒(ju)絕的(de)情況下就要(yao)承擔支付(fu)(fu)加班工(gong)(gong)(gong)資的(de)義(yi)務(wu),因為(wei)它并(bing)不屬于加班。在既無(wu)勞動(dong)(dong)法律法規明文規定(ding)(ding),又無(wu)雙方事先約定(ding)(ding)的(de)情形下,工(gong)(gong)(gong)貿公司并(bing)沒有支付(fu)(fu)該項加班工(gong)(gong)(gong)資的(de)義(yi)務(wu)。
