最近招聘了一些(xie)新員工,想咨詢一下大(da)家(jia),員工工作態度不好(hao)怎么(me)辭(ci)退?

。《勞(lao)動(dong)(dong)合同(tong)(tong)法(fa)(fa)》第(di)三十(shi)六(liu)條(tiao)(tiao)(tiao)規定:“用人單位(wei)(wei)(wei)與勞(lao)動(dong)(dong)者(zhe)(zhe)協商(shang)一(yi)致,可以解(jie)除(chu)勞(lao)動(dong)(dong)合同(tong)(tong)。”同(tong)(tong)時,第(di)四十(shi)六(liu)條(tiao)(tiao)(tiao)要(yao)求,用人單位(wei)(wei)(wei)依照本(ben)法(fa)(fa)第(di)三十(shi)六(liu)條(tiao)(tiao)(tiao)規定向勞(lao)動(dong)(dong)者(zhe)(zhe)提出解(jie)除(chu)勞(lao)動(dong)(dong)合同(tong)(tong)并與勞(lao)動(dong)(dong)者(zhe)(zhe)協商(shang)一(yi)致解(jie)除(chu)勞(lao)動(dong)(dong)合同(tong)(tong)的(de)(de),應當向勞(lao)動(dong)(dong)者(zhe)(zhe)支付經(jing)濟補償。不(bu)過,單位(wei)(wei)(wei)提出協商(shang)解(jie)除(chu)勞(lao)動(dong)(dong)合同(tong)(tong),是(shi)依法(fa)(fa)給予經(jing)濟補償的(de)(de)充分(fen)條(tiao)(tiao)(tiao)件,而(er)不(bu)是(shi)必要(yao)條(tiao)(tiao)(tiao)件。不(bu)能(neng)理解(jie)為,依法(fa)(fa)給予了經(jing)濟補償,單位(wei)(wei)(wei)就一(yi)定能(neng)夠協商(shang)解(jie)除(chu)。是(shi)否能(neng)夠成功(gong)解(jie)除(chu),還(huan)要(yao)看勞(lao)動(dong)(dong)者(zhe)(zhe)的(de)(de)意思。如(ru)(ru)果勞(lao)動(dong)(dong)者(zhe)(zhe)認為自己也(ye)同(tong)(tong)意解(jie)除(chu),那雙(shuang)方皆(jie)大歡喜。但(dan)如(ru)(ru)果勞(lao)動(dong)(dong)者(zhe)(zhe)不(bu)同(tong)(tong)意協商(shang)解(jie)除(chu),單位(wei)(wei)(wei)可能(neng)需要(yao)抬(tai)高加碼,或者(zhe)(zhe)放棄協商(shang)解(jie)除(chu)這一(yi)途(tu)徑。
