問(wen) 最近招聘了一(yi)些新(xin)員工(gong)(gong),想(xiang)咨詢一(yi)下大家,員工(gong)(gong)工(gong)(gong)作態度不好怎么辭退?

。《勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)法》第三十六(liu)條(tiao)(tiao)規(gui)定:“用人單位(wei)與勞(lao)(lao)(lao)(lao)動(dong)(dong)者協商(shang)一致(zhi),可(ke)以解除(chu)(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)。”同(tong)時,第四十六(liu)條(tiao)(tiao)要求,用人單位(wei)依(yi)照本(ben)法第三十六(liu)條(tiao)(tiao)規(gui)定向勞(lao)(lao)(lao)(lao)動(dong)(dong)者提出解除(chu)(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)并(bing)與勞(lao)(lao)(lao)(lao)動(dong)(dong)者協商(shang)一致(zhi)解除(chu)(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong)的,應當向勞(lao)(lao)(lao)(lao)動(dong)(dong)者支付(fu)經(jing)(jing)濟補(bu)償。不(bu)(bu)過,單位(wei)提出協商(shang)解除(chu)(chu)勞(lao)(lao)(lao)(lao)動(dong)(dong)合同(tong),是依(yi)法給予經(jing)(jing)濟補(bu)償的充(chong)分條(tiao)(tiao)件(jian),而不(bu)(bu)是必要條(tiao)(tiao)件(jian)。不(bu)(bu)能(neng)理解為,依(yi)法給予了經(jing)(jing)濟補(bu)償,單位(wei)就一定能(neng)夠(gou)協商(shang)解除(chu)(chu)。是否能(neng)夠(gou)成功(gong)解除(chu)(chu),還要看勞(lao)(lao)(lao)(lao)動(dong)(dong)者的意(yi)思(si)。如(ru)果勞(lao)(lao)(lao)(lao)動(dong)(dong)者認為自己(ji)也同(tong)意(yi)解除(chu)(chu),那雙方(fang)皆大歡喜。但如(ru)果勞(lao)(lao)(lao)(lao)動(dong)(dong)者不(bu)(bu)同(tong)意(yi)協商(shang)解除(chu)(chu),單位(wei)可(ke)能(neng)需(xu)要抬(tai)高(gao)加碼,或者放棄(qi)協商(shang)解除(chu)(chu)這一途徑(jing)。
