臨時工有權索要加班費嗎?

臨時(shi)工沒有(you)與用(yong)(yong)人單位(wei)簽訂勞動合同,他們以一定時(shi)間內完成某項工作未條件,但是若臨時(shi)工被加班,可(ke)以向用(yong)(yong)人單位(wei)索(suo)要(yao)加班費嗎?

《勞(lao)(lao)動(dong)(dong)合同(tong)法》第31條(tiao)也(ye)(ye)指出:用人(ren)單(dan)位(wei)應當嚴(yan)格執(zhi)行(xing)勞(lao)(lao)動(dong)(dong)定(ding)(ding)額標準,不(bu)得強迫或者(zhe)變相強迫勞(lao)(lao)動(dong)(dong)者(zhe)加班(ban)。用人(ren)單(dan)位(wei)安(an)排(pai)加班(ban)的,應當按照國(guo)家(jia)有關規定(ding)(ding)向(xiang)勞(lao)(lao)動(dong)(dong)者(zhe)支(zhi)付(fu)加班(ban)費。鑒于這(zhe)些規定(ding)(ding)針對的是全體(ti)(ti)勞(lao)(lao)動(dong)(dong)者(zhe),而(er)臨時工(gong)雖然具(ju)有季節性(xing)和臨時性(xing),但(dan)因屬(shu)于勞(lao)(lao)動(dong)(dong)者(zhe)群體(ti)(ti)之一,自然也(ye)(ye)不(bu)能(neng)例外。
