我剛剛進入(ru)職場(chang)是個新(xin)人,現在(zai)想咨詢一下,請問哪些情況(kuang)下屬違法(fa)安排加(jia)班加(jia)點?

首先強迫(po)加(jia)班(ban)(ban)加(jia)點(dian)(dian):用人單位未(wei)與工(gong)(gong)(gong)(gong)(gong)會和勞動(dong)(dong)(dong)者(zhe)協商,強迫(po)勞動(dong)(dong)(dong)者(zhe)延(yan)長(chang)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian)的,應給(gei)予警告,責令改正(zheng),并可按每(mei)(mei)名(ming)勞動(dong)(dong)(dong)者(zhe)每(mei)(mei)延(yan)長(chang)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian)1小(xiao)時(shi)罰(fa)(fa)款100元以下(xia)的標(biao)準處(chu)罰(fa)(fa)。其次超(chao)時(shi)加(jia)班(ban)(ban)加(jia)點(dian)(dian):用人單位每(mei)(mei)日延(yan)長(chang)勞動(dong)(dong)(dong)者(zhe)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian)超(chao)過3小(xiao)時(shi)或每(mei)(mei)月延(yan)長(chang)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian)超(chao)過36小(xiao)時(shi)的,應給(gei)予警告,責令改正(zheng),并可按每(mei)(mei)名(ming)勞動(dong)(dong)(dong)者(zhe)每(mei)(mei)超(chao)過工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian)1小(xiao)時(shi)罰(fa)(fa)款100元以下(xia)的標(biao)準處(chu)罰(fa)(fa)。最后違(wei)法要求女職(zhi)工(gong)(gong)(gong)(gong)(gong)加(jia)班(ban)(ban)加(jia)點(dian)(dian):用人單位安(an)排懷孕(yun)7個月以上的女職(zhi)工(gong)(gong)(gong)(gong)(gong)延(yan)長(chang)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian),或者(zhe)在(zai)哺乳未(wei)滿1周歲的嬰兒期(qi)間(jian)(jian)安(an)排女職(zhi)工(gong)(gong)(gong)(gong)(gong)延(yan)長(chang)工(gong)(gong)(gong)(gong)(gong)作時(shi)間(jian)(jian),應責令改正(zheng),并按每(mei)(mei)侵害一(yi)名(ming)女職(zhi)工(gong)(gong)(gong)(gong)(gong)罰(fa)(fa)款3000元以下(xia)的標(biao)準處(chu)罰(fa)(fa)。
