把假期折算成錢給員工,這種做法可以嗎?

員工(gong)有帶薪休假,但公(gong)司不給休,把假期折算成錢(qian)給員工(gong),這種(zhong)做法可以嗎?

《職(zhi)(zhi)工(gong)(gong)(gong)帶薪年(nian)休(xiu)(xiu)(xiu)假(jia)條例》第五(wu)條:“單位(wei)(wei)確(que)因工(gong)(gong)(gong)作需(xu)要(yao)不(bu)能安排職(zhi)(zhi)工(gong)(gong)(gong)休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)的,經(jing)(jing)職(zhi)(zhi)工(gong)(gong)(gong)本人同意(yi)(yi),可以(yi)不(bu)安排職(zhi)(zhi)工(gong)(gong)(gong)休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)。對職(zhi)(zhi)工(gong)(gong)(gong)應(ying)休(xiu)(xiu)(xiu)未休(xiu)(xiu)(xiu)的年(nian)休(xiu)(xiu)(xiu)假(jia)天(tian)數,單位(wei)(wei)應(ying)當按(an)照該職(zhi)(zhi)工(gong)(gong)(gong)日工(gong)(gong)(gong)資收入的300%支付年(nian)休(xiu)(xiu)(xiu)假(jia)工(gong)(gong)(gong)資報酬。”所以(yi),在征得員工(gong)(gong)(gong)同意(yi)(yi)的前(qian)提下,單位(wei)(wei)可以(yi)將未休(xiu)(xiu)(xiu)年(nian)休(xiu)(xiu)(xiu)假(jia)通(tong)過折錢(qian)的方式(shi)給員工(gong)(gong)(gong)。不(bu)過要(yao)注意(yi)(yi),折錢(qian)的標(biao)準是給3倍的工(gong)(gong)(gong)資。考(kao)慮到正常的一(yi)倍工(gong)(gong)(gong)資已經(jing)(jing)發放(fang)了,所以(yi)在具體操作時,補發2倍工(gong)(gong)(gong)資即可。
