我跟公(gong)司簽訂過競(jing)(jing)業(ye)協議,想咨(zi)詢一下,競(jing)(jing)業(ye)協議的補償,一般是怎么計算(suan)的?

當事(shi)人在(zai)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)或(huo)者(zhe)(zhe)(zhe)保(bao)密協議中約定了競業限制,但未約定解除(chu)或(huo)者(zhe)(zhe)(zhe)終(zhong)(zhong)止(zhi)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)后給予勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)經濟(ji)補償,勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)履(lv)行了競業限制義務(wu),要求(qiu)用人單位按(an)照勞(lao)(lao)動(dong)(dong)者(zhe)(zhe)(zhe)在(zai)勞(lao)(lao)動(dong)(dong)合同(tong)(tong)解除(chu)或(huo)者(zhe)(zhe)(zhe)終(zhong)(zhong)止(zhi)前十二個(ge)月平均工資的30%按(an)月支付經濟(ji)補償的,人民法院應予支持。前款規定的月平均工資的30%低于勞(lao)(lao)動(dong)(dong)合同(tong)(tong)履(lv)行地最低工資標準的,按(an)照勞(lao)(lao)動(dong)(dong)合同(tong)(tong)履(lv)行地最低工資標準支付。
