績效(xiao)工(gong)(gong)資(zi)(zi)和(he)崗(gang)位工(gong)(gong)資(zi)(zi)作為勞動(dong)報酬的一部分,屬于月(yue)最低(di)(di)工(gong)(gong)資(zi)(zi)的組成部分。即(ji)使勞動(dong)合同中(zhong)約定的基本工(gong)(gong)資(zi)(zi)低(di)(di)于最低(di)(di)工(gong)(gong)資(zi)(zi)標準,加上績效(xiao)工(gong)(gong)資(zi)(zi)、崗(gang)位工(gong)(gong)資(zi)(zi)后(hou)扣除個人繳納的社保(bao)和(he)公積金后(hou),仍(reng)然高于最低(di)(di)工(gong)(gong)資(zi)(zi)標準的,就是合法的。
