我們公(gong)司是個銷(xiao)售公(gong)司,想咨詢一下,拿績(ji)效工資(zi)當基本(ben)工資(zi)合法嗎?

績(ji)效(xiao)(xiao)工(gong)(gong)資(zi)(zi)和崗位工(gong)(gong)資(zi)(zi)作為勞(lao)動報酬的(de)一部分,屬于(yu)月最(zui)(zui)低(di)工(gong)(gong)資(zi)(zi)的(de)組成部分。即使勞(lao)動合同中約定的(de)基本工(gong)(gong)資(zi)(zi)低(di)于(yu)最(zui)(zui)低(di)工(gong)(gong)資(zi)(zi)標準,加(jia)上績(ji)效(xiao)(xiao)工(gong)(gong)資(zi)(zi)、崗位工(gong)(gong)資(zi)(zi)后扣除(chu)個人繳納(na)的(de)社保和公積金后,仍然高于(yu)最(zui)(zui)低(di)工(gong)(gong)資(zi)(zi)標準的(de),就是合法的(de)。
