首先據《勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)法(fa)》第(di)82條(tiao)規定,用(yong)人(ren)單(dan)位(wei)自用(yong)工(gong)之(zhi)(zhi)日(ri)起超過一(yi)個(ge)(ge)月(yue)不(bu)滿一(yi)年未與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)訂(ding)立(li)書面勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)的(de),應(ying)當(dang)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)每月(yue)支付二(er)倍(bei)的(de)工(gong)資(zi)。最多(duo)支付11個(ge)(ge)月(yue)的(de)雙倍(bei)工(gong)資(zi)。其次(ci)用(yong)人(ren)單(dan)位(wei)違反(fan)法(fa)律規定不(bu)與勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)訂(ding)立(li)無固(gu)定期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)的(de),自應(ying)當(dang)訂(ding)立(li)無固(gu)定期(qi)限(xian)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)之(zhi)(zhi)日(ri)起向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)每月(yue)支付二(er)倍(bei)的(de)工(gong)資(zi)。勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合(he)同(tong)(tong)到期(qi)后(hou),用(yong)人(ren)單(dan)位(wei)不(bu)續(xu)簽,又(you)不(bu)解除(chu)合(he)同(tong)(tong),繼續(xu)用(yong)工(gong)的(de),超過一(yi)個(ge)(ge)月(yue)后(hou)應(ying)該(gai)向(xiang)勞(lao)(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者(zhe)(zhe)每月(yue)支付二(er)倍(bei)的(de)工(gong)資(zi)。
