答 首先據《勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)法》第82條規(gui)定(ding),用(yong)人單(dan)(dan)位(wei)自用(yong)工(gong)(gong)之日起超過(guo)一個(ge)月不(bu)滿一年未與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)訂立書面勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)(de)(de),應當向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)每(mei)月支付(fu)(fu)(fu)二(er)倍(bei)的(de)(de)(de)工(gong)(gong)資(zi)。最多支付(fu)(fu)(fu)11個(ge)月的(de)(de)(de)雙倍(bei)工(gong)(gong)資(zi)。其(qi)次(ci)用(yong)人單(dan)(dan)位(wei)違反(fan)法律規(gui)定(ding)不(bu)與勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)訂立無(wu)固定(ding)期限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)的(de)(de)(de),自應當訂立無(wu)固定(ding)期限(xian)勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)之日起向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)每(mei)月支付(fu)(fu)(fu)二(er)倍(bei)的(de)(de)(de)工(gong)(gong)資(zi)。勞(lao)(lao)(lao)動(dong)(dong)合(he)(he)同(tong)(tong)(tong)到期后,用(yong)人單(dan)(dan)位(wei)不(bu)續簽,又不(bu)解除合(he)(he)同(tong)(tong)(tong),繼續用(yong)工(gong)(gong)的(de)(de)(de),超過(guo)一個(ge)月后應該(gai)向勞(lao)(lao)(lao)動(dong)(dong)者(zhe)(zhe)每(mei)月支付(fu)(fu)(fu)二(er)倍(bei)的(de)(de)(de)工(gong)(gong)資(zi)。
