答 《勞動合同法(fa)實(shi)施條(tiao)例》,其中第二(er)十七(qi)條(tiao)明確:“勞動合同法(fa)第四(si)十七(qi)條(tiao)規定的經濟補償的月工(gong)(gong)資(zi)(zi)(zi)按照(zhao)勞動者應(ying)得(de)工(gong)(gong)資(zi)(zi)(zi)計算(suan),包括(kuo)計時工(gong)(gong)資(zi)(zi)(zi)或(huo)者計件工(gong)(gong)資(zi)(zi)(zi)以及獎金、津(jin)貼和補貼等貨幣(bi)性收入(ru)。……勞動者工(gong)(gong)作不滿12個(ge)月的,按照(zhao)實(shi)際工(gong)(gong)作的月數(shu)計算(suan)平均工(gong)(gong)資(zi)(zi)(zi)。”這條(tiao)規定,明確了“勞動者應(ying)得(de)工(gong)(gong)資(zi)(zi)(zi)”是(shi)經濟補償金月工(gong)(gong)資(zi)(zi)(zi)的計算(suan)依據,所有貨幣(bi)性收入(ru),都(dou)屬于應(ying)得(de)工(gong)(gong)資(zi)(zi)(zi)的范圍。
