按(an)照《企業(ye)(ye)職工(gong)工(gong)傷(shang)保險試行(xing)辦法(fa)》規定(ding)職工(gong)因(yin)工(gong)作(zuo)遭(zao)受事故傷(shang)害或(huo)者(zhe)患(huan)職業(ye)(ye)病(bing)需(xu)要暫停(ting)(ting)(ting)工(gong)作(zuo)接受工(gong)傷(shang)醫療(liao)的(de),在(zai)停(ting)(ting)(ting)工(gong)留(liu)薪期(qi)內(nei),原工(gong)資福利待遇不變,由(you)所在(zai)單位(wei)按(an)月支付。這(zhe)就是停(ting)(ting)(ting)工(gong)留(liu)薪期(qi)。條(tiao)款規定(ding):“停(ting)(ting)(ting)工(gong)留(liu)薪期(qi)一(yi)般不超(chao)過(guo)12個月。傷(shang)情(qing)嚴重(zhong)或(huo)者(zhe)情(qing)況(kuang)特殊,經設區(qu)的(de)市(shi)級(ji)勞動能力鑒定(ding)委員(yuan)會確認,可(ke)以適當延長(chang),但(dan)延長(chang)不得超(chao)過(guo)12個月。工(gong)傷(shang)職工(gong)評定(ding)傷(shang)殘(can)等級(ji)后,停(ting)(ting)(ting)發原待遇。工(gong)傷(shang)職工(gong)在(zai)停(ting)(ting)(ting)工(gong)留(liu)薪期(qi)滿后仍需(xu)治療(liao)的(de),繼續享受工(gong)傷(shang)醫療(liao)待遇。”
