能辭退不簽勞動合同的員工嗎?

在實(shi)際生活中(zhong),有的勞(lao)動者由于個人原(yuan)因(yin)不愿意(yi)簽訂勞(lao)動合同(tong),請(qing)問像這樣情況能辭(ci)退不簽勞(lao)動合同(tong)的員工嗎(ma)?

《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法》第(di)十條(tiao)(tiao)規(gui)定:“建(jian)立(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi),應(ying)當訂立(li)書(shu)面(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。已建(jian)立(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi),未同(tong)時訂立(li)書(shu)面(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的(de)(de),應(ying)當自(zi)用(yong)(yong)工(gong)之日(ri)起一(yi)個月(yue)內訂立(li)書(shu)面(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)。”《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)法實(shi)施條(tiao)(tiao)例(li)》第(di)五(wu)條(tiao)(tiao)規(gui)定:“自(zi)用(yong)(yong)工(gong)之日(ri)起一(yi)個月(yue)內,經(jing)(jing)用(yong)(yong)人單(dan)位(wei)書(shu)面(mian)(mian)通(tong)知(zhi)(zhi)后,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者不與(yu)用(yong)(yong)人單(dan)位(wei)訂立(li)書(shu)面(mian)(mian)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)合同(tong)的(de)(de),用(yong)(yong)人單(dan)位(wei)應(ying)當書(shu)面(mian)(mian)通(tong)知(zhi)(zhi)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者終(zhong)止勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)關系(xi),無需向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者支(zhi)付(fu)經(jing)(jing)濟補償,但是應(ying)當依法向勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)者支(zhi)付(fu)其實(shi)際工(gong)作時間(jian)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)報酬(chou)。”
