能辭退不簽勞動合同的員工嗎?

在實(shi)際(ji)生活中,有的勞動(dong)者由于個(ge)人原因不愿意簽訂勞動(dong)合同(tong),請問像這樣(yang)情況(kuang)能辭退(tui)不簽勞動(dong)合同(tong)的員工嗎?

《勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)》第十條(tiao)(tiao)規定:“建(jian)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系,應(ying)當(dang)訂立(li)(li)書(shu)(shu)面(mian)(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。已(yi)建(jian)立(li)(li)勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系,未同(tong)(tong)時(shi)訂立(li)(li)書(shu)(shu)面(mian)(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de),應(ying)當(dang)自(zi)(zi)用(yong)工(gong)之(zhi)(zhi)日起一(yi)個(ge)月(yue)內(nei)訂立(li)(li)書(shu)(shu)面(mian)(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)。”《勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)法(fa)實(shi)施條(tiao)(tiao)例》第五條(tiao)(tiao)規定:“自(zi)(zi)用(yong)工(gong)之(zhi)(zhi)日起一(yi)個(ge)月(yue)內(nei),經用(yong)人單(dan)位書(shu)(shu)面(mian)(mian)通知后,勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)不(bu)與用(yong)人單(dan)位訂立(li)(li)書(shu)(shu)面(mian)(mian)勞(lao)(lao)動(dong)(dong)(dong)(dong)合(he)(he)(he)同(tong)(tong)的(de),用(yong)人單(dan)位應(ying)當(dang)書(shu)(shu)面(mian)(mian)通知勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)終(zhong)止勞(lao)(lao)動(dong)(dong)(dong)(dong)關(guan)系,無需向勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)支(zhi)付經濟補償,但是應(ying)當(dang)依(yi)法(fa)向勞(lao)(lao)動(dong)(dong)(dong)(dong)者(zhe)支(zhi)付其實(shi)際工(gong)作時(shi)間的(de)勞(lao)(lao)動(dong)(dong)(dong)(dong)報酬。”
