能辭退不簽勞動合同的員工嗎?
問 在實際(ji)生活(huo)中(zhong),有的勞動者由于個(ge)人原(yuan)因不愿意簽(qian)訂勞動合同,請問像這樣情況能(neng)辭退不簽(qian)勞動合同的員工嗎?
答 《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)法》第十條規定(ding)(ding):“建立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi),應當訂立書面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)。已建立勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi),未(wei)同(tong)時訂立書面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)的,應當自(zi)用(yong)工之日(ri)起一個月內(nei)訂立書面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)。”《勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)法實(shi)施(shi)條例》第五條規定(ding)(ding):“自(zi)用(yong)工之日(ri)起一個月內(nei),經用(yong)人單(dan)位書面(mian)通知后(hou),勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者不與用(yong)人單(dan)位訂立書面(mian)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)合同(tong)的,用(yong)人單(dan)位應當書面(mian)通知勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者終止勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)關(guan)(guan)系(xi),無需向(xiang)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者支付(fu)經濟補(bu)償,但是應當依法向(xiang)勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)者支付(fu)其(qi)實(shi)際(ji)工作時間的勞(lao)(lao)(lao)(lao)(lao)動(dong)(dong)(dong)報酬。”
