不能補休的該怎么辦啊?

清明節我們公司沒有放(fang)假(jia),想咨(zi)詢一下大(da)家,不(bu)能(neng)補休的該怎(zen)么(me)辦(ban)啊?

《勞(lao)(lao)動(dong)(dong)法(fa)(fa)(fa)》第(di)44條、勞(lao)(lao)動(dong)(dong)部《工(gong)資(zi)支(zhi)付(fu)暫(zan)行規定(ding)(ding)(ding)(ding)》第(di)十三條,用(yong)人單位在(zai)勞(lao)(lao)動(dong)(dong)者(zhe)完成勞(lao)(lao)動(dong)(dong)定(ding)(ding)(ding)(ding)額或(huo)規定(ding)(ding)(ding)(ding)的(de)工(gong)作(zuo)(zuo)任務后,根據實際需要(yao)安(an)排勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)法(fa)(fa)(fa)定(ding)(ding)(ding)(ding)標(biao)準工(gong)作(zuo)(zuo)時(shi)(shi)(shi)(shi)間(jian)以外加(jia)班(ban)加(jia)點的(de),事后應盡(jin)量給予同(tong)等時(shi)(shi)(shi)(shi)間(jian)的(de)補休。確(que)實不能補休的(de),應按(an)以下標(biao)準支(zhi)付(fu)加(jia)班(ban)加(jia)點工(gong)資(zi):   (1)依法(fa)(fa)(fa)安(an)排勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)日(ri)法(fa)(fa)(fa)定(ding)(ding)(ding)(ding)標(biao)準工(gong)作(zuo)(zuo)時(shi)(shi)(shi)(shi)間(jian)以外延長工(gong)作(zuo)(zuo)時(shi)(shi)(shi)(shi)間(jian)(加(jia)點)的(de),按(an)照勞(lao)(lao)動(dong)(dong)合(he)同(tong)規定(ding)(ding)(ding)(ding)的(de)勞(lao)(lao)動(dong)(dong)者(zhe)本人小時(shi)(shi)(shi)(shi)工(gong)資(zi)標(biao)準的(de)150%支(zhi)付(fu)工(gong)資(zi)。   (2)依法(fa)(fa)(fa)安(an)排勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)休息(xi)日(ri)工(gong)作(zuo)(zuo)的(de),按(an)照勞(lao)(lao)動(dong)(dong)合(he)同(tong)規定(ding)(ding)(ding)(ding)的(de)勞(lao)(lao)動(dong)(dong)者(zhe)本人日(ri)或(huo)小時(shi)(shi)(shi)(shi)工(gong)資(zi)標(biao)準的(de)200%支(zhi)付(fu)工(gong)資(zi)。   (3)勞(lao)(lao)動(dong)(dong)者(zhe)在(zai)法(fa)(fa)(fa)定(ding)(ding)(ding)(ding)休假節日(ri)工(gong)作(zuo)(zuo)的(de),按(an)照勞(lao)(lao)動(dong)(dong)合(he)同(tong)規定(ding)(ding)(ding)(ding)的(de)勞(lao)(lao)動(dong)(dong)者(zhe)本人日(ri)或(huo)小時(shi)(shi)(shi)(shi)工(gong)資(zi)標(biao)準的(de)300%支(zhi)付(fu)工(gong)資(zi)。
