勞(lao)(lao)(lao)動(dong)(dong)和社會保障(zhang)部頒布的(de)(de)《最(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)規(gui)(gui)定(ding)》規(gui)(gui)定(ding):在(zai)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)提(ti)供正常勞(lao)(lao)(lao)動(dong)(dong)的(de)(de)情(qing)況(kuang)下(xia),用(yong)人單(dan)位(wei)應(ying)支付給勞(lao)(lao)(lao)動(dong)(dong)者(zhe)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)在(zai)剔(ti)除下(xia)列各項以后,不(bu)得(de)低(di)于(yu)(yu)當地最(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)標準:(一)延(yan)長工(gong)(gong)(gong)作時間工(gong)(gong)(gong)資(zi)(zi);(二)中班(ban)、夜班(ban)、高溫、低(di)溫、井下(xia)、有(you)毒有(you)害等特殊工(gong)(gong)(gong)作環境、條件下(xia)的(de)(de)津貼(tie);(三)法律、法規(gui)(gui)和國家規(gui)(gui)定(ding)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)者(zhe)福利待遇等。實(shi)行計(ji)件工(gong)(gong)(gong)資(zi)(zi)或提(ti)成(cheng)工(gong)(gong)(gong)資(zi)(zi)等工(gong)(gong)(gong)資(zi)(zi)形式的(de)(de)用(yong)人單(dan)位(wei),在(zai)科學合理(li)的(de)(de)勞(lao)(lao)(lao)動(dong)(dong)定(ding)額基礎上,其支付勞(lao)(lao)(lao)動(dong)(dong)者(zhe)的(de)(de)工(gong)(gong)(gong)資(zi)(zi)不(bu)得(de)低(di)于(yu)(yu)相應(ying)的(de)(de)最(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)標準。據(ju)此,延(yan)長工(gong)(gong)(gong)作時間工(gong)(gong)(gong)資(zi)(zi)(即(ji)加班(ban)費(fei))不(bu)能作為(wei)最(zui)低(di)工(gong)(gong)(gong)資(zi)(zi)的(de)(de)組成(cheng)部分。
