加班費算在最低工資標準里么?
問 最近(jin)公司讓(rang)我們加了三天班,想(xiang)咨詢一下大家(jia),加班費算(suan)在(zai)最低工資標準(zhun)里么?
答 勞動(dong)和社會(hui)保障部頒布(bu)的(de)《最(zui)低工(gong)(gong)資(zi)規定(ding)(ding)》規定(ding)(ding):在(zai)勞動(dong)者提供正常勞動(dong)的(de)情況下(xia)(xia),用人單位應支付(fu)給勞動(dong)者的(de)工(gong)(gong)資(zi)在(zai)剔除下(xia)(xia)列各項以后,不得(de)低于當地(di)最(zui)低工(gong)(gong)資(zi)標準:(一)延(yan)長(chang)工(gong)(gong)作(zuo)時間工(gong)(gong)資(zi);(二)中班、夜班、高溫、低溫、井下(xia)(xia)、有毒有害等(deng)特(te)殊工(gong)(gong)作(zuo)環境(jing)、條件下(xia)(xia)的(de)津貼;(三)法律、法規和國家規定(ding)(ding)的(de)勞動(dong)者福利(li)待遇等(deng)。實(shi)行計件工(gong)(gong)資(zi)或提成工(gong)(gong)資(zi)等(deng)工(gong)(gong)資(zi)形式的(de)用人單位,在(zai)科學(xue)合理的(de)勞動(dong)定(ding)(ding)額基礎上,其支付(fu)勞動(dong)者的(de)工(gong)(gong)資(zi)不得(de)低于相應的(de)最(zui)低工(gong)(gong)資(zi)標準。據(ju)此,延(yan)長(chang)工(gong)(gong)作(zuo)時間工(gong)(gong)資(zi)(即加班費(fei))不能(neng)作(zuo)為(wei)最(zui)低工(gong)(gong)資(zi)的(de)組成部分(fen)。
