答 勞(lao)動(dong)(dong)和社(she)會保障部(bu)(bu)頒布的(de)《最(zui)(zui)低工(gong)(gong)資(zi)(zi)規(gui)定(ding)(ding)》規(gui)定(ding)(ding):在(zai)勞(lao)動(dong)(dong)者提供正常勞(lao)動(dong)(dong)的(de)情況(kuang)下(xia),用(yong)人單(dan)位(wei)應支付給勞(lao)動(dong)(dong)者的(de)工(gong)(gong)資(zi)(zi)在(zai)剔除下(xia)列各項以后,不得低于(yu)(yu)當地最(zui)(zui)低工(gong)(gong)資(zi)(zi)標準(zhun):(一)延長(chang)工(gong)(gong)作時間(jian)工(gong)(gong)資(zi)(zi);(二(er))中班、夜班、高(gao)溫(wen)(wen)、低溫(wen)(wen)、井下(xia)、有毒有害等特殊工(gong)(gong)作環境、條件(jian)下(xia)的(de)津(jin)貼;(三)法(fa)律、法(fa)規(gui)和國家規(gui)定(ding)(ding)的(de)勞(lao)動(dong)(dong)者福利待(dai)遇等。實行計(ji)件(jian)工(gong)(gong)資(zi)(zi)或提成(cheng)工(gong)(gong)資(zi)(zi)等工(gong)(gong)資(zi)(zi)形式(shi)的(de)用(yong)人單(dan)位(wei),在(zai)科(ke)學合理的(de)勞(lao)動(dong)(dong)定(ding)(ding)額基礎上,其支付勞(lao)動(dong)(dong)者的(de)工(gong)(gong)資(zi)(zi)不得低于(yu)(yu)相應的(de)最(zui)(zui)低工(gong)(gong)資(zi)(zi)標準(zhun)。據此,延長(chang)工(gong)(gong)作時間(jian)工(gong)(gong)資(zi)(zi)(即(ji)加班費)不能作為最(zui)(zui)低工(gong)(gong)資(zi)(zi)的(de)組(zu)成(cheng)部(bu)(bu)分。
