我們是一(yi)下新(xin)公司,想咨詢一(yi)下,用人單位在制(zhi)定、修改或者決(jue)定有關勞動報酬、工作(zuo)時間的(de)怎么辦(ban)啊?

根據《勞(lao)(lao)動(dong)(dong)(dong)合同法(fa)》第4條規(gui)定(ding),用人(ren)單位(wei)在(zai)制(zhi)(zhi)(zhi)定(ding)、修改或(huo)(huo)者(zhe)決定(ding)有(you)(you)關(guan)勞(lao)(lao)動(dong)(dong)(dong)報酬、工(gong)作(zuo)時間(jian)、休(xiu)息休(xiu)假、勞(lao)(lao)動(dong)(dong)(dong)安全(quan)衛生、保險福利(li)(li)、職(zhi)(zhi)工(gong)培訓、勞(lao)(lao)動(dong)(dong)(dong)紀律以及(ji)勞(lao)(lao)動(dong)(dong)(dong)定(ding)額管(guan)理等直接涉及(ji)勞(lao)(lao)動(dong)(dong)(dong)者(zhe)切身利(li)(li)益的(de)(de)(de)規(gui)章(zhang)(zhang)制(zhi)(zhi)(zhi)度(du)或(huo)(huo)者(zhe)重大(da)事項(xiang)時,應當經職(zhi)(zhi)工(gong)代表大(da)會或(huo)(huo)者(zhe)全(quan)體職(zhi)(zhi)工(gong)討論,提出方案和(he)意見,與(yu)工(gong)會或(huo)(huo)者(zhe)職(zhi)(zhi)工(gong)代表平等協商確定(ding)。在(zai)規(gui)章(zhang)(zhang)制(zhi)(zhi)(zhi)度(du)和(he)重大(da)事項(xiang)決定(ding)實(shi)(shi)施過(guo)程(cheng)中,工(gong)會或(huo)(huo)者(zhe)職(zhi)(zhi)工(gong)認為不適(shi)當的(de)(de)(de),有(you)(you)權向(xiang)用人(ren)單位(wei)提出,通(tong)過(guo)協商予以修改完善(shan)。通(tong)過(guo)以上條款可以看出,該法(fa)特別規(gui)定(ding)了職(zhi)(zhi)工(gong)或(huo)(huo)者(zhe)工(gong)會對(dui)用人(ren)單位(wei)規(gui)章(zhang)(zhang)制(zhi)(zhi)(zhi)度(du)提出異(yi)議的(de)(de)(de)權利(li)(li)。較之《勞(lao)(lao)動(dong)(dong)(dong)法(fa)》的(de)(de)(de)規(gui)定(ding)相比,不僅進一(yi)步明確和(he)擴大(da)了規(gui)章(zhang)(zhang)制(zhi)(zhi)(zhi)度(du)的(de)(de)(de)范圍,而且對(dui)規(gui)章(zhang)(zhang)制(zhi)(zhi)(zhi)度(du)的(de)(de)(de)制(zhi)(zhi)(zhi)定(ding)、修改、實(shi)(shi)施都作(zuo)出了明確的(de)(de)(de)規(gui)定(ding)。
