由于我國就業競爭(zheng)激烈的(de)(de)國情以(yi)及《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)法》發展歷(li)史,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系中用人單位(wei)與(yu)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者雙方地位(wei)的(de)(de)不平(ping)等性,造成了事實勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系的(de)(de)存在。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)是勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系建(jian)立、變(bian)更和終止的(de)(de)一(yi)種(zhong)法律形式。根據《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)法》第十條的(de)(de)規(gui)定,建(jian)立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系的(de)(de),應當(dang)及時訂(ding)立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。已經建(jian)立勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)(guan)系,但未同(tong)時訂(ding)立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)的(de)(de),應當(dang)自用工之日起(qi)一(yi)個月內訂(ding)立書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。
