由于(yu)我國(guo)就業競(jing)爭激烈的國(guo)情以(yi)及《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)法》發展歷史,勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系中用人單位(wei)與勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)者雙方地位(wei)的不平(ping)等性(xing),造成了事(shi)實勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系的存在。勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)是勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系建立(li)(li)、變更和終止的一(yi)(yi)種法律形式(shi)。根(gen)據《勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)法》第十條(tiao)的規定,建立(li)(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系的,應(ying)當(dang)及時訂立(li)(li)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。已經(jing)建立(li)(li)勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)關(guan)系,但未同(tong)時訂立(li)(li)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)的,應(ying)當(dang)自用工之日起一(yi)(yi)個月內訂立(li)(li)書(shu)面勞(lao)(lao)(lao)動(dong)(dong)(dong)(dong)(dong)合同(tong)。
