由于我國(guo)就業競爭激(ji)烈的(de)國(guo)情以及《勞動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)》發展歷史,勞動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)中用人單位與勞動(dong)(dong)(dong)(dong)者雙方(fang)地位的(de)不平等性,造成了(le)事實(shi)勞動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)的(de)存在。勞動(dong)(dong)(dong)(dong)合(he)同(tong)是勞動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)建(jian)(jian)立(li)(li)、變更和(he)終止的(de)一種(zhong)法(fa)律(lv)形式(shi)。根據(ju)《勞動(dong)(dong)(dong)(dong)合(he)同(tong)法(fa)》第(di)十條的(de)規定,建(jian)(jian)立(li)(li)勞動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi)的(de),應當(dang)及時(shi)(shi)訂(ding)(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)(dong)(dong)合(he)同(tong)。已(yi)經建(jian)(jian)立(li)(li)勞動(dong)(dong)(dong)(dong)關(guan)(guan)系(xi),但未(wei)同(tong)時(shi)(shi)訂(ding)(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)(dong)(dong)合(he)同(tong)的(de),應當(dang)自用工之日起一個月內訂(ding)(ding)立(li)(li)書(shu)面(mian)勞動(dong)(dong)(dong)(dong)合(he)同(tong)。
